Complaint about Capital One Credit Card

My credit card payment was due on July 15th.  I made 3 payments. On June 28th, July 10th and July 14th (registered on July 15th) and that would have paid the statement amount in full.  The website does not give any confirmation number for the payment, and it specifies in multiple ways that if you don't see your payment, it's because it takes a couple of days.

I was surprised to see today (July 17th) that the July 14th payment has been posted but the July 7th payment is not posted.  With no confirmation number, the company essentially said that I was a liar.  They charged me interest on all the charges made on that account and told me that since I did not make the full payment, I will be charged interest on every single amount that I charge on that account in this following month as well.

Don't be a fool! I was one but now I know better!  Capital One is founded on fraud.

Complaint: Against Capital One

It seems Capital One also does not protect it's customer's accounts from Internet Fraud even though their advertising clearly states they offer 100% Internet Fraud Protection. So the trick is this - they collude with the merchant to confuse the customer - even if you refuse to be confused. I was being charged $7.50 a month on a Capital One Card - I called the merchant "Web Services" and hey claimed I did not have an account with them. They said they would check and credit my card if there had been an error. Charges continued, but they came in under different names, "Web Upgrade", "Web Technical" and finally a URL that I had owned in the past and never used. So I called Capital One and disputed the charges. I got a new car about ten days later and when I called to activate the new card I was told the merchant had agreed the charges were in error. The get a calla few days later from some rude girl who says that I can only get my money back for a few months because of some time limit!
it. I told her that's not 100% fraud protection and I was quite pissed. She got back to me few days later after I complained to her superiors and she got the merchant on the phone with me - and at that point I am told that I had to have ordered something because they didn't just have my credit card number, they had my address too. I point out to the dumb customer service girl that anyone who has any of the dozens of URL's I own can get all that information from a Who is lookup on the Internet - which I then walked her through a few of my sites and even Capital One's own site - it gave all the contact info, etc. So much for that excuse. Then the merchant claimed that if I bought a URL that I had to buy web space to go with it - and I told him he was full of it, that most registrars provide free URL parking - and that I have a dedicated server for my web sites so why would I hire his rinky dink company and why would I put it on my personal card when I have business cards for these!
e things? Duh! But guess what, the girl at Capitol One was so stupid that despite everything I showed her and hearing me successfully challenge the merchant, she still insisted if they had my telephone and address, I had to have authorized the charges.  I pointed out all the different merchant names they used, none of which was the merchant's real name? I pointed out how every other re-occurring charge I have on my business cards gives me a notification at least every 90 days via email, or each time they ding the card at all! I couldn't even figure out who this merchant was when I called them. No matter, this chick was obviously told to eliminate the complaint and she simply refused to see it any way but hers.

So ATT is not the only one with fraudulent advertising, Capital One is right up there with them. You're only protected from the fraud if Capitol One says it's a fraud. If it's a fraud and Capitol One says it's a mistake, it's still fraud.  Only your not getting kissed first.

Thank you for posting this!!  I get offers from Capital One all the time in the mail.  I can tell you I will never own a Capital One card.    These Credit Card Companies hold all the cards and the deck is stacked against you.  Something should be done about this.  We should have more rights or protection against these money hungry pirates.

Complaint: Capital One - I do admit that we were over the limit on our credit card.  I called to pay the card off and was ready to pay the amount that was provided in a letter I had just received today.  When I called, I was told the balance was over $50 higher.  When I asked, no one, not the supervisor, nor the assistant to the President, could give me an answer.  Is this fraudulent accounting?  I think so.  I have cancelled my account and I urge everyone to cancel their cards and tell others about these types of accounting practices.

Please Help !!!!
My 18 year old son has a Capital One credit card with a $100.00 credit limit. With a balance near the limit (90 something) he called Capital One and asked for the card to be canceled. He then mailed a minimim due payment of $10. The request to cancel the account was on September 5, 2003. On Nov 12, 2003 a company that my son did business with a year earlier, charged what is presumed to be an annual fee to the account which pushed his debt to $102.00 ( 2 dollars over the limit ) The next statement showed the charge plus late fees and over limit fees totaling $170.25.
How does a credit card company allow charges to your account when they clearly have it on record that a cancel request was made.
How do they allow it to get so out of control that the total due is almost double the amount at the time of the cancel request.
The vendor that was allowed to make the charge is Stamps.com which has been impossible to reach. There is no option to make a complaint or cancel subscription on their website, they are virtually impossible to reach by phone, they put me on hold for 40 minutes before I had to hang up and get on with my life.
There is some fault on my (my son's) part but this is clearly another example of big business out of control, doing as they please, bullying and intimidating people.
They will not bully or intimidate me, I will fight this until it is resolved to my satisfaction and you can be sure that I will never do business with Capital One or Stamps.com ever again and I will spread the word to anyone that will listen.
If you are aware of similar situations and know any way to resolve this matter, any and all (serious)advice would be appreciated.

Capitol One ruined my credit rating:

I feel sorry for all of us who have been hurt by Capitol One.
For me, I was a victim when one day I wanted to cancel my card. Balance $400.  No problem because I had the money, however, I was a week late in mailing the check. I had forgotten. No big deal only a 7 day delay in mailing the full amount.

I called Capitol 1 and relayed my accident. I apologized, and reassured them that the full amount was going in the mail today.  I asked them to verify the balance (because I knew after 7 days they probably would add a dollar or two and I wanted to pay the exact amount.)

    How wrong I was:

I was told by customer service rep. named Greg, "Actually sir, your balance is $600".  ONLY 7 DAYS HAD PAST!  I replied to Greg that I would mail the original $400 check with $20 added for a week inconvience PERIOD.  Greg stated that they will not take a check for less than the whole amount of $600.

I asked Greg to verify to me that just 7 days ago my balance was only $400. He said "Yes, but that's not the balance now".  This back and forth continued.......For two months I argued with them.  After two months my balance was then bumped to $1,500!  As of today, the balance is over $2,900.

Can someone tell me how a company can legally get away with stealing from we consumers like this?  My credit report is ruined for years and years to come. How is our government allowing them to do this?!

Capitol One - I still have your $400. You purposefully would not accept the full payment.  You purposefully were treating me this way in order to get more money out of me.  You wrongfully drug out an argument in order to tack on as much fees as possible hoping to swindle me out of thousands more dollars than what I owed.

You are a company of thieves.

Complaint:
The scam is this:  for the past several months I've noticed a finance charge of around $0.91 on my monthly statement.
Every month, I pay my new balance on the day that it's due, but I've noticed that this finance charge never goes away.
My expectation is that the new balance represents the total of what I owe to Capital One and that once I pay that, the balance becomes zero and I owe them nothing.
However, by paying the total balance off, it turns out that I am not paying off everything that I owe:  there is a cash advance of around $53 from last summer that is generating the monthly finance charge.
This $53 is not included in the balance, so that when I pay my new balance every month, I am not paying off the $53 and it keeps generating a finance charge of around $0.91.
This is extremely disturbing because the only way for me to pay off this outstanding cash advance and stop the $0.91 monthly finance charge is not to pay the new balance (as one would expect, since the definition of balance is payments minus liabilities), but to overpay the new balance by the outstanding amount.
Isn't it illegal (or at the very least, extremely unethical) to state a balance that does not include the full amount owing?  Isn't a balance loosely defined as:  "pay this amount and you don't owe us anything"?
In this case, the loose definition is "pay this amount, but there is still a hidden amount that you owe that will generate finance charges, unless you overpay to eliminate this hidden amount".
I'm deeply disturbed by this.  Not that the money is significant.  It's just that if I pay the amount of the new balance (this is the amount indicated on the payment portion of the invoice) in full every month, like a good customer, I will still never know about this remnant of a cash advance from last year.

Complaint: Capital One has made a habit of holding payments to ensure they are "past due" so they can charge an additional fee.  Three months in a row, I paid well in advance of the due date, only to see on my next statement that they were ALL applied to the account one day past due. I finally got wise, and sent payments in by certified mail, with a return receipt. Sure enough, they were receiving them up to a week early, but holding them until the were past due. I called, and they cheerfully took the late charge off my account...but not before raising the interest rate, due to delinquent payment history. I cancelled my card, and paid off the balance, only to see a "membership fee" of $40 on the next card. I called and told them I would not pay this amount, as I had cancelled my card, and was assured it would be taken off my next statement. The following month, I owed over $70: the original $40, plus another late charge.  It took me 4 months and threats of a lawsuit to get r!
id of these charges.

Complaint: I had a credit card with Capital One for some time. When I was billed an annual fee recently, I immediately paid the account in full and closed the account since I have cards that do not charge an annual fee. Despite 4 requests in writing and numerous e-mails, this fee hasn't been credited back to the closed account. I was told that it would be, but now it is showing past due and I am being charged a huge late fee. Shame on this company for taking advantage of consumers in this way.

Hello,

I am unsure who I should contact with my complaint, so I am writing you folks.  I have a capital one credit card.  I went over my limit by $8.  Capital One has a phone system calling me every half hour telling me to contact a specific number.  The phone system calls from an "Out of Area" phone number and makes no mention of Capital One.

I paid the over due balance as soon as I realized that this machine was going to call me at home every half hour (1 day after listening to the message).  I paid the over due amount through their online system (05/03/04).  The Capital One phone system resumed calling me every half hour today (5/4/04).  I decided to call the number listed and informed the person on the phone that I would like to not be harrassed by their phone system and to take me off their "list.  The CSR told me that I would be taken off the list.

Half an hour later the phone rings and it is the phone system again.  This time I call Capital One and ask to speak to someone who can stop the phone system from calling.  The person say's that they see that I have made a payment, but the phone system would continue to call me until it reset at midnight.  I told the CSR that it was unacceptable that a phone system would harass me PERIOD and nevermind that I already have paid the over due amount and spoken with a CSR to stop the phone system from calling.

The operator informed me that if I made a payment right now, she could get the system to stop trying to contact me.  I agree, I certainly was angry, but I can't have my phone ringing every half hour for no reason.  So, I basically paid my bill twice, just to get their automated system to leave me alone.

Well, I am still receiving calls from the automated phone system.  I can't believe this type of practice is legal.

Are there any steps I can take?:

Thanks,

Jason

Capital One

I have 3 Capital One credit cards, one of them was with K-Mart and had a $600.00 credit limit.  I was working on repairing my credit and all three cards had very low balances.  I had stopped using the K-Mart card and was working to pay the balance down by sending a few bucks extra each month.  I had it setup on online bill payment and sent it the same time each month.  Everything was fine until I stopped using the card, seems the payment was never posted in a reasonable manner after that.  Not paying close enough attention to a couple of the statements, before I new it I had over $200.00 that was due ASAP because of late fees and over limit.  The annual fee slipped in there also which put me over the limit.  I called, it is not easy getting in, finally talked to someone and they said they would help me out.  I also requested on the phone and in writing a copy of the last two statements, I never got statements or help.  Of course in record time I was sent to a collection age!
ncy.  First one I tried to talk to, but was pretty upset with how my phone conversations had been going so I requested documentation of my debt in detail, along with the collection companies information.  I got a demand letter for over $1,500.00, yes almost 3X my credit limit.  I again requested the documentation, sent to another collection agency, went through the same thing and yes got sent to the 3rd collection agency, by now it was over $1700.00!  Still wanted a copy of my statement, by this time I had made that request at least 8 times.  This time the collection agency turned me over to an attorney's office.  I again asked for the statement (now I was on a mission) in Jan 04.  In Feb 04 I emailed them and asked about the statements, the email stated "they have been ordered" and that was it.  Never received never got another phone call or statement.  On Monday May 31st, 2004 I got a summons to appear in court on June 21st, 2004.

I tried to make arrangements with the Attorney that Capital One attacked me with, now it is over $2000.00 and it will go up 25.9 each month.  This has not even been a year!  I even made payments after my house was partially destroyed in the May 4, 2003 tornado!  I have had a very bad year and I need a break.   I need the balance to stop increasing an allow me a payment schedule to pay it off.

Complaint:
I received a ridiculous rate increase in all of my Capitol One Credit Cards without cause. I sent in full payment to close all of my 3 accounts and the payment was based on the balance due given to me by their customer service person. Within the three days of my check arriving to close the account, a auto pay from a internet service arrived to the credit card company changing my new balance by $19.00. Needles to say the Credit Card company accepted the charge and processed it although I requested cancellation. Two months went by and I received a call that I had an outstanding payment of $194.00 and wanted to know when I was going to pay it.

Let me start by stating that I never have been late in any of my credit cards. It was obvious that I believed that my account was officially closed and as I am always bombarded with junk mail from Capitol One I never paid any attention to their mail. They claimed that they had sent me a monthly statement which I don't deny., but once more I was under the impression that when I asked for the account to be closed that such request was processed. Since then, they have maintained the account open and charged me $90.00 in late fees and $69.00 for a renewal yearly fee. I was and still am pissed off about their dealings. I hate Capitol One and will never do business with them again. Any recourse advice will be appreciated.

Complaint: I had a Capital One account that was open but unused.  I did not receive statements every month because there was no activity (at least I figure that is why.)  The first statement I receive in months shows balance overdue. I call to find out what's up--it's the annual fee plus late fee.  I say cancel the account.  The rep says how about if we remove the late fee, cut the fee in half and you keep the account open.  I say OK I did the same thing last year.  I wait for a corrected statement and instead I get the next monthly notice that shows that the first late fee was removed, the annual fee cut in half, but now there's another late fee added.  I call and say, this is too much hassle for a card I don't even use; close the account.  The rep says I will close the account and you will not be liable for any fees.  I apply for a draft overprotection card from my mortgage bank and am denied; one reason is delinquent accounts.  I order my credit report and lo and behold Cappital One has reported that I am 30 days or more delinquent on my account--the one they said they would close and recind all fees.  So I call the Capital One 800 number to find out what's up.  I get nothing but a recording that says your account has zero balance and after one cycle you will receive a notice of official closure.  I want to talk to a rep to find out why I got another statement that says I am overdue, but the recording says that's all they know about my account until the next day at 8 AM Eastern time.  I call the next day several times throughout the day and get nothing but the recording saying the same thing.  So now they have screwed up my credit and won't even allow me to talk to a rep.  I've sent them a letter, with a copy to the credit reporting agency demanding that they correct my credit record.  I will also be filing a complaint with appropriate state and federal agencies (if there are any).

Complaint:
It is important that consumers know the unethical business policies of Capitol One Credit Card.  I got a secured credit card with Capitol one back in 1996.  The purpose of this card was to rebuild my credit by depositing $500 to a saving account that they held as security for my redit card account.  Over the years the savings balance grew to over $650 with accrued interest.  I have used the card as a revolving credit for all these years, paying all fees charged to me even though some of them were exhorbitant.  In October of 2003 I spoke to a customer service rep at Capitol One letting them know that I needed to cancel my card because my job was coming to and end.  At that time the balance on my account was approx $750 and the savings approx $650.  I asked the rep to cancel my card and apply the savings to my card and I would pay the remaining balance to close my account.  Not one but three different reps including one supervisor said that I would have to pay the card balanc!
e in full first, and they would send my savings balance.  I explained to no avail that the savings account IS my money on account to insure that I keep my account in good standing.  It is for this very reason I got a secured card... to avoid my credit suferring because of things outside my control.  I called monthly and noone would honor my request.  Meanwhile the card accrued interest charges causing it to go well over the limit, over the limit charges, late fees, and they even had the audacity to charge an annual card member fee.  The card balance swelled to over $1200.  In January of 2004, Capitol One sent me a statement showing that they applied my savings balance to the $1200 balance they racked up and the balance due after exhuasting my savings account is now
over $600 dollars.  I refused to pay.  Collectors have been calling since
November who refused to see the gross injustice in this practice.  At this point lawyers are calling me treatening to sue for this balance.  I explained to one caller that I will take a stand on this. She asked me "what makes you think you can win agains a gib company like Capitol one?  They have high powered lawyers you know and this will wreck your credit."  I explained to her, by doing this, you have already wrecked my credit and took my money to boot! I would rather take it to court.  At the very least, I will have my say and make people aware of their practices. Until the consumer stands up, we will continue to be ripped off and taken advantage of.  Thank you for letting me vent.

Sincerely,

Beverly Rivers

Captial One is out to Screw you!

They send you a pre-approved rate of 2.99% on balance transfers and then transfer your balances at 9.99% with out informing you that they have approved your credit at this incredibly high rate. They do not give you the option of transfering the balance or not. My balances on previous cards were half as much as their approved rate. I am now required to pay $100 dollars more a month on the minimum at an additional 7% interest. If this isn't fraudulent I don't no what is. They are ripping off the consumer.

Complaint: I had a capitol one card for 3 years. I spoke only good things about it for a long time UNTIL...I noticed that I was being charged a monthly fee! WHAT? I signed up for the card in the first place because it was totally free. So I called and the person I talked to was so stupid. She told me that it was totally legal for them to change anything on my account whenever they wanted. And that the reason why I was paying this fee now is because I was late on my payments. OH I had only been late 3 times in the 3 freakin years I'd been with the company. So I asked her why I had not been informed of the change (which was made 4months earlier). And she said that it was noted at the bottom of my statement that month. I told her I was not impressed by her intelect because I had been recieving only online statements for the last year, and it was not on any of those. "Then you would have noticed the charge on your itemized statement" she siad. THE NERVE! Oh I'm sorry I didn't know you where in the business of charhing me for fee's I'm unaware of and hoping I see it. That just pissed me off beyond repair so I imediatly told her to close my account. She said it was in closing and as soon as I paid my balance. So I emptied my savings account and put this all behind me. Or so I thought! Just for fun I logged onto my account 3 months later. And guess what I saw... My account was not only still active but the monthly fee that I was so angry about had gone "unpaid" and I had over 90$ in late fee's, not to mention the ruining of my credit! So I called and they said they had no record of me closing my account. What idiots! So since I didn't have the date that I called or the name of the person I talked to I was at fault. Eventually I got them to close my account and take way the late fee's but I was stuck with those stupid monthly fee's which where the reason for all of this. These people DO NOT CARE about ethics or honesty. I did nothing to deserve the tre!
atment that i got. And in the end they will always WIN. Do not get this card because ther's no annual fee, they WILL find a way to get your money!

Complaint:

This is a rough draft of the script of a phone call I plan to make on Monday to Capital One.

"A phone call to the Capital One Credit Card Collections Department."
*** SCRIPT ***
Hello is this the Capital One Collections Department?
My name is Jeff R. and I am calling about my account.
I am blind and I am recording this phone call for my records, is that OK with you?
If yes, thank you.
If no, do you mean that you have the right to record this conservation, but I, as your customer do not have that right?

**KEEP RECORDING ANYWAY***

This account was opened in my name jointly with my ex girlfriend (Lisa M.) I believe it had a $250 limit. I don't think I ever actually signed for anything purchased on the card myself. I believe my ex girlfriend made all purchases. We broke up three or four years ago, about three months prior to the last time the card was used.

I don't remember the exact month and date, but when she moved out I asked her to destroy her card. My credit as a homeowner was the reason the card was issued.

The only reason I/we originally obtained the card was to establish credit after my disability discharge from the Navy after 12 years of active duty because of blindness. I then paid off the card in full, destroyed my card, and called Capital One and asked them to cancel the account, or at least take my name off of the card.

Capital One did not honor the request, because the next month I had to pay more money my ex had charged up. I again called capital One and asked them to cancel my name on the card. A month later I was sent another bill. I called Capital One and said I refuse to pay any more charges. I never signed for anything that was charged. And as far as I was concerned my ex girlfriend should be responsible because I asked you to cancel the card.

The only choice Capital One gave me was keep paying for charges not authorized by myself, or stop paying and Capital One would eventually cancel the card if my ex girlfriend didn't pay the charges. She had no intentions to pay the charges. She didn't live in the same state. I had no contact information for her. She was just going to keep using the card as long as it worked.

I think this is outright fraud and/or embezzlement on the part of Capital One. I was unable to destroy the card held by my ex-girlfriend living a different state.

Now Capital One has about $400 plus listed on my credit report.

Capital One is well aware that:
I am a service connected blinded U.S. Navy Veteran
I spent 12 years on active duty before becoming disabled
I have owned my home since 1994

I recently obtained a home equity loan. I live in Sarasota, Florida and am in desperate need of home repairs like air conditioning. In order to borrow the needed home equity from the Navy Federal Credit Union. They (the Navy Federal Credit Union) told me they had to send me a check payable to Capital One to pay off the $400 plus, which is on my credit report. They would send the check to me because they don't have my full account number.

Does this mean after I send you (Capital One) the check you are going to re-activate the credit card against my wishes? Does this mean that my ex can did the card out of her wallet again to find it working again? Are you going to start this crazy nightmare again!
We weren't even married! I haven't seen her for years!

So, I guess Capital One Won. Your corporate greed makes me sick to my stomach. I hope you don't have an American Flag on your credit cards. This is a fine way to treat your disabled veterans. How do you people sleep at night? I am sending this letter to my local media, and will try to post it all over the Internet.

Perhaps an attorney will read this and agree with me about Capital Ones practice being illegal. Please contact me if you can represent me Pro Bono to sue this corporate greedy giant.

This is CAPITALoneISM!

By the way Capital One, congratulations on your record profit last quarter. I am sorry you had to close your Tampa Office and fire several hundred of my neighbors last week.

You know what they say; "Your Check's in the Mail".

May you Greedy Bastards all rot in Hell,

Bad mistake I would make my payments they would send me a thank you for my payment, then after the payment due date I would receive a letter telling me that the payment did not go thru and I was charged late charges, then after the late charges were added it would make my account over the limit so they would charge me again. They told me to go back and redo my information which I did, same thing happened. I have three other bills that I pay online and have never had a problem. Now I keep getting phones demanded that I make a payment over the phone which I will not do, I am tired of the threats since I feel that the extra charges were wrong.

Complaint:
Until August of 2002 I had a Capital One MasterCard and paid it off every month.  In July of that year I booked two package trips to San Diego for my friend Jan and myself; when my bill arrived I had been charged twice for each package and assessed an overage fee from Capital One.  I telephoned them and they told me Southwest Airlines had a 'glitch' in their computer system and had now refunded the extra charges; they agreed to reverse the overage charge.

But only one of the extra charges was removed, and it took me so long to make Capital One understand and remove the second charge, that I cancelled the card and paid off the bill in full.  In October I started to receive bills again, and that charge from Southwest had been put back on.  After two years of filing grievances, sending letters, spending hours on the telephone and everything I could think of, I wasn't any further in the process than when I began.  Southwest Airlines claimed they had reversed all the extra charges.

When I renegotiated my mortgage, Washington Mutual insisted that $1,705.00 be paid to Capital One.  Explanations of the situation never reached them, because the money is handled by an escrow company who refused to do anything about it.  I called Capital One and agreed to settle with them for $850.  In order to finish my mortgage re-negotiation, I had to pay them money I never owed them.

When Capital One asks in that commercial, 'What's in Your Wallet?'  Be sure your answer is: NOT CAPITAL ONE!

Complaint:
My husband had a capital one card and tried to pay off the balance. But when capital one was contacted he was informed that they had sold his debt to a collection company and no longer held the account.  He then asked when did this happen for he had not heard anything and had been making monthly payments to capital one.  He was told that his debt was sold over a year earlier.

He found out who bought his account and contacted them, but to his susprise they were wanting the full amount of the orginal debt. He told them that that can not be right that he has been paying capital one each month a set amount (more then the minum payment)each month.  The collection company stated that they had not received anything in the way of payments on his account.

So, back to capital one, where he asked where his payments were going, he had the cancelled checks to show he had been paying.  He was then informed that all the payments he had sent to them were just for interest and late fees that were on going even thro capital one sold the debt.  They also told him that they did not have to tell him that they had sold the debt and that since the checks were made out to capital one that they had the right to keep the money. Needless to say he contacted the collection company and informed them that he will not be paying anything to them until his payments were credited to his account.  He told them to send it to their leagle deparment. He was told by the collection company that there was a form that he would have to fill out.

Two years later after filling out the forms and returning them he had not heard anything from either capital one or the collection company. Until he wanted to get a new job.  Now a days most employers do a credit check before hireing new people.  when my husbans credit was run there it was an outstanding balance from capital one, so my husband had to contact them. Now he has found out that for the past two years interest and late charges have been adding up on this debt that no one bothered to contact him over. He wanted to pay the debt at one time but he didn't know who to pay.

I really can't see how any of this is leagle:

1. capital one sold the account, once an account is sold all interest and fee's stop. so how could they still collect money for interest and late fee's?

2. they sold a debt with out any notice to the comsumer, to whom they sold the debt to so that the right people would be paid.

3. how can they keep collecting fee's and interest for two years and let the debit balance grow without notice to the comsumer?  they have the address and phone number. God knows that they called it enough at one time.

We need to get the word out that capital one is nothing but a pond of leaches that will suck you to dust as soon as you get you feet wet.

I had my own capital one card and had problems also, I was lucky enough to get it paid off. I did call and tell them to close the account and that I better not or never see a statment from them again with any charges of any kind.  I checked my credit report the card still shows as active but no balance and I have not heard from them.  But I am still watching my back for I do not trust them in the least.

Thank you for letting me vent, but this will still not stop capital one from hurting other unexpecting victims...comsumers.

Complaint:
Having been with CapitalOne for years, aside from the occasional late payment fee that I was (in my opinion wrongfully) charged, I would have until recently rated them highly. I will now be cancelling the card.

To make a long story short, they have charged me $20 in finance charges on a card that I paid in full last month. - With a bill of over $6000 and my interest rate having gone through the roof, I decided to pay in full and eliminate the $100 plus monthly finance charges. I did just that.

With a balance now at zero, I expected my next bill to only show my automatic $19.95 internet fee and a couple of minor purchases made since paying in full, I assumed that I would have no finance charges because no purchases were over 30 days old. To my suprise I had the $20 finance charge.

The explanation I was giving when I called was: "We see that your balance was zero..." however, "...You have never paid in full before.". When asked what that had to do with it, I was given some garbage about a "grace period" and told I had to pay in full to avoid finance charges!!!!

I WILL pay in full (including the $20 they are stealing from me) THEN I will take my business elsewhere!

Complaint:
I obtained a Capital One small business credit card with a small maximum (of a few hundred dollars) so that I could interns, assistants, etc. in my company use the card to help me run errands. The limit on the card was kept purposely small so that I could control expenditures. I was assured by Capital One that no charges would be allowed over the authorized limit. Yet, when an assistant charged a coffee at Starbucks, Capital One not only authorized the charge--they sent me a penalty of $30 along with it. I called to point out the error--which took several hours on the phone for them to admit--and they promised it would never happen again. But two months later they did the same thing. And did it again. And again. And again. Each time it happens, I spend hours on the phone with them. Each time they swear it will never EVER happen again.

Tonight I am on the phone to cancel the card. (I mean, after six mistakes on their part and a totally ruined credit rating, would you believe them?) Typically, I have been:
-transferred to the wrong desk--TWICE
-been on hold since 9:20 P.M. EST (It is now about 10:30 P.M. EST)

Capital One Are A Bunch Of Crooks,

It is now January 2005, I made a payment of $1700.00 in July to pay off the Capital One credit card to stop the interest payments that were ridiculous and fraudulant. I found out in September of 2004 that the $1700.00 payment was not received. I went to my bank and they started a trace and the trace revealed that Capital One did receive the money. I phoned the company and thought everything was fine the balance was at zero. Then in December I receive another bill from Capital One and the $1700.00 charge is back on. I phoned the company and they told me they had no records of any trace or payments and that I still owe the money. I called my bank and they started another trace tracked my payment and sent in all documentation to Capital One. I called Capital One to see if they received the information and they said they did not. I finally put my bankers name on my card and she has been dealing with the problem and has sent the information again, it is now January of 2005. If I!
was you I would avoid Capital One they are thieves and are dishonest. If you have a problem you will never get the same person to talk to so you never know what is going on!

Dee R. from Georgia

I received a letter from CapitalOne that if I transferred a balance from another credit card that I would get a 2.99% fixed interest rate.  There is a trick to this if you don’t read the letter very carefully.  It only guarantees you 2.99% interest on the transferred money, not on any future purchases you make on the CapitalOne credit card, which is 9.90% interest.  I will limit my credit card to the minimum since I caught on to what they were doing.  It seems they must have to stay up all night to come up with new ideas to get your money.

  Capital one sucks

Complaint: Capital one are a bunch of thieves. I got a balance transfer from them at 5.9% until the balance was paid off. Eight months later without any notice my rate was jacked to 14.9% for NO reason what so ever!  They said I received a notice, but they lied and you have no way to prove them wrong. I have paid at least $40.00 over the minimum payment each month. I have perfect credit and have never been late on any payment to anyone, that's how I got the 5.9 rate in the first place. The customer service people will lie to you and tell you that a supervisor is NOT available to speak to when you are actually talking to a supervisor. I would advise anyone who is holding a Capital one card to do whatever you have to do to get rid of it. Sooner or later they will screw you, it's the way they do business!

Complaint: Capital One is a company that is very customer unfriendly.  They are the king of all customer-no-service. We have had 2 accounts with them. We have never been late ever and have a FICO score of 794 with excellent credit. Capital One arbitrarily changed our Annual Percentage Rate from 7.90% (as our contract reads) to 45.99%. I contacted their customer-no-service and received two unacceptable answers from their rep and their supervisor: 1)"it states that on the statement but we really didn't charge that rate" 2)"that is for tax purposes and an overall rate for the life of the card" (this from the supervisor before he thanked me for calling and hung up on me).  This "Annual Percentage Rate applied this period..." reads the same on every statement for the past 5 years - but this time indicates an increase from 7.90 to 45.99. I could not obtain any explanation for this increase and because our balance is only 300 they don't want to talk to us. Do yourself a favor and s!
tay away from Capital One and if you are a card holder check your annual percentage rate very carefully on each and every statement.  This is the 2nd time they have done this to us.

I closed one of my accounts with Capital One.  They even sent me an overpayment check for $12.44.  To my suprise I was billed again for this closed account.  Capital One said that I still had an account open and they would continue to bill me until it's closes.
Capital One had no authorite to keep this account open.  I even contacted the merchant and informed them about the account being closed.
I received a statement today for $187.43.  I was told that the Federal Trade Commission maybe able to give advice.  I was given this number to call (202) FTC-HELP or visit there website www.ftc.gov. I did file a com- plaint with them.  Hopefully they can help.
If there's any other place I can file please e-mail me.

I've been a faithful customer/consumer of Capital One now for 3 years.  They have kept me at a $200 credit limit with no increase.  Recently, one of my payment was not applied on the accnt so they charged me with a late fee.  Then, the next billing cycle came and because they didn't post my payment, it went over the limit after the late fee and finance charge were both assessed.. this meant an over the limit fee was charged also.

I called Capital One Customer Service to explain it to my understanding.  The first rep got fustrated and hung up on me.  I called back, the second rep started yelling at me and giving me an attitude because I wanted to repeat everything to confirm what the first rep was saying.  I called back to talk to the Supervisor.  And of course, she told me NO ONE had documented my earlier calls.  As far as Capital One was concerned, I never called in to speak with any of their "customer service" reps... so much for customer care right??

Yeah, well word of mouth will be part of my personal mission here.
DO NOT EVER APPLY FOR CAITAL ONE!!  THEY ARE A SECOND CHANCE CREDIT CARD COMPANY.  THEY ISSUE CREDIT TO PEOPLE TRYING TO REBUILD OR JUST START CREDIT.  THEREFORE, IN THEIR EYES "YOU" ARE SECOND BEST AND WILL TREATED ACCORDINGLY.  DON'T BELIEVE ME?? THEN TAKE THE RISK AND LEARN FROM EXPERIENCE!!!!

Complaint:
This complaint is about Capital One.  A few years ago I had a Capital One card.  Mysteriously, I didn't receive one of the billing statements.  Like most busy people, I didn't realize that I didn't get the statement until the next statement arrived.  Surprised I called them to explain why my payment was late.  Their answer was to increase my percentage rate.  Needless to say, as soon as possible I cancelled the card.

P.S. Since 1985 when I moved to NJ, I have not received only three pieces of mail:  Capital One Bill, MBNA bill and a Bank One bill.
Curious don't you think.

Recently I saw a very nice promotion by Capital One: "Prime Rate for Life" was the advertisement:  a percentage rate that would be for as long as I had the card.  And then the missing bill syndrome started.  I didn't receive a bill.  I called them to explain I didn't get it and was told that they would send me a copy of the bill and take off the $35 late fee.  They did take off the late fee, however, I never received the missing bill.  They sent me the bill before and after, but not the correct bill.
In addition, they increased my interest rate to 9.9%.  Nice going.

I am interested in being part of a class action suit against Capital One.
I am also interested in being a part of a lobby to change the way credit card companies do business.

1.  No more changing interest rates for any reason.
2.  No more credit cards to those who are not employed, do not pass credit card worthiness, and no more cards to students (unless specifically limited).
3.  All credit card rules, procedures and requirements should be written in plain english and in normal print.
4.  Any changes to the account have to be notified to each subscriber by letter stating exactly what the changes are and why.(including rate changes, grace period changes and limit changes).
5.  Limits put on late fees, transaction fees etc.
6.  A telephone contact number printed in bold and large numbers on your billing statement so that you can call to fix any problems arrising from of your account.
7.  Billing statements that are legible and easy to read form.

After contacting Capital One to tell them to cancel my account, I was told that before I could close it, I would have to bring the balance down to zero.  I mailed them a check for the $18.45 to pay off the account in plenty of time to make it there and be processed by the due date.
The next thing I know, I get a bill for 18.45, plus .50 plus a $29 late fee!!!
I realize that the dollar amount is not that big of a deal, but from a company that notoriously pulls this crap all the time. This really pisses me off!!  Needless to say Capital One will be eternally on my fecal roster.
Is there any recourse for a consumer at this point???

Complaint:
Hi!

A couple of months ago I was checking out my credit report I decided to close some credit card accounts I had because I simply wasn't using them.  I tried to close a Capital One account I had.  I initially called them with my request to close the account on december of 2004 and they told me that the account had to have a $0 balance for the next thirty days and then it would be closed.  Since I didn't use the card at all that wasn't a problem.  About 2 months later I was checking out my credit report again on www.Freecreditreport.com and it still showed the account as open,  I though this was a mistake because they told me that it would take 30 days and they cancelled my online service (almost immediately after I put in my request in the first place) and I stopped receiving any statements in the mail also.  But they didn't cancell the offer mailings.

I called Capital one and told them about my credit report showing the account as open and they comfirmed it.  They told me that the account was still open.  I asked about the reason and they told me that I never requested it to be closed,  that their records indicated that the call I made on december was to report a lost card.  But that didn't make any sense because they immediately cancelled my online service and cancelled my statement mailings.

I put in a second request to close the account and again they told me 30 days with a balance of $0.  It is now april on 2005.  I checked my credit report again and the account was still open.  I called capital one again and they confirmed it again.  They told me it was in closing status but it has been like that for about 2 more months now, and again they told me another 30 days.

Before I initially put in my request to close the account I asked for a credit limit increase in order to keep the card because they were just giving me a credit limit of $300 and I had two other credit cards with around $4000 credit limit each. I was going to close one of the other ones and keep my capital one card because they were the ones that gave me a credit  card in the first place, and I appreciated that.  But they denied my request for the credit limit increase and I just didn't have use for a credit card with $300 credit limit because I was always worrying about going over my limit. I was never late on my payments and I don't think I ever gave them a reason to deny my request, but oh well.

I was considering applying for another type of credit card with Capital one befor all this trying to close the account thing started but now I will never do bussiness with them again.  Frankly it's scary to think that there are companies out there with such moraly wrong procedures, and they hold the power in their hands to ruin somebody's credit.

My wife had the same problem with capital one years ago.  She says that she requested her account to be closed and never gave it a second thought after.  They also stopped her mail but never closed her account.  She found out her account was still open about five years later when she applied for a loan.

My only advise to anybody who is trying to close an account with Capital one is to follow the process very closely until you can make sure that it is in fact closed.  I would recommend online services like www.Freecreditreport.com.  If it weren't for that service, today I wouldn't have any clue as to the real status of the account, and for about $70 a year I think it's worth it.  Just think of the money it can save you if you apply for a loan.

Well, thanks for reading and good luck to you.

Sincerely
Ricardo Gonzalez

Complaint: I have a CapitalOne Visa Platinum on which I took a cash advance of 140.00. I pay this cards balance in full every month. They proceeded to charge me finance charges on 205.89. The finance charges on this amount are only a couple of dollars.  Yet, when I called to ask why these charges had been made I was told I had the wrong amounts and was hung up on by two different service representatives.

Complaint:
I've had many problems with Capital One - fees etc. - payments not being posted on time and so forth. The last case had to do with an overlimit fee. I had intentionally called to set up my account to not be able to go over the limit. I was told that gas purchases sometimes do not go through right away - this would be an exception to the set-up. Also, if a payment is done manually - they may have to let it go through and I would still be charged the fee. As it happens - they have still allowed regular charges to go through - and then charged the fee. I was able to get them to remove it a couple times - also had some not-legit late fees removed - then they began telling me I'm at my limit for fee removals - we can't remove any more fees even if its OUR fault. Not one to give up - I found that if you keep calling and calling and calling - sooner or later - you'll find someone who will agree to take the non-legit charge off. PERSISTANCE is the key - don't let these people win -!
if its a fee that should not be on there - and you're having trouble getting it removed - call, call, call, and call again - I know its a pain - but when they finally take that fee off - there's no feeling like it.  Remember - be persistant - have a good arguement and don't take no for an answer - sooner or later (usually later) YOU SHOULD WIN. so far I haven't had to write to the many agencies etc. but damn - some of these credit cards are evil - I love how when you call - they claim to be customer service - WHAT A JOKE !!

COMPLAINT CONTAINS MAILING ADDRESS FOR CEO OF CAPITAL ONE

The copy of the letter below tell the story:

May __, 2005

Mr. Richard D. Fairbank
President & CEO
Capital One Financial Corp
1680 Capital One Drive
McLean, VA 22102 [Address from Yahoo Financial]

NOTICE OF INTENT TO FILE COMPLAINT WITH VIRGINIA ATTORNEY GENERAL
REASON: HOLDING GOOD CREDIT HOSTAGE, OTHER VIOLATIONS

Dear Mr. Fairbank:

Capital One is holding my good credit hostage through lies and subterfuge.  There is currently a housing crisis where I live and the loss of the asset of the good credit I built up with you is serious.  Multiple attempts to get you to report my use of credit had no effect.  Your employees claimed twice that you would at least sent me a letter confirming my account history and use of credit but they never did.  This is not an accident.  I've found many accounts online of similar behavior by your company intended to prevent your customers from leaving you and getting credit elsewhere.

You also charged me for late fees even though I mailed my checks in time
(and there are plenty of complaints about you doing this online)
You preventing me from closing my account by subterfuge (and there are plenty of complaints about you doing stuff like this online.)  Dealing with Capital One has wasted incredible amounts of my time.  You've for sure lost a customer for life and I'm not the only one.

I WANT:

My good credit reported accurately under BOTH my organization's name (and employer ID number) and my own name and social security number.  That report should say that I paid my bill on time for three years, except for one thirty days late payment, and that the account is it now closed and paid in full.  This should all be reported to the three main credit reporting agencies under both names and as well as Dunn & Bradstreet for the organization.  You made me personally guarantee this account and if I assume the liability I deserve the credit too.

I want $1,000 for the loss up to now of my good credit history, stress, much wasted time and punitive damages.  This includes roughly a hundred dollars for improperly charged late fees.  This amount is symbolic and in no way reflects the true losses involved.  I will ask for more later if I have to file a complaint or lawsuit.

If my credit has not been accurately reported within 30 (thirty) days from the receipt of this letter, and I have not received a check for this amount I will file a complaint with the Attorney General of Virginia.

Sincerely

(this customer)

Complaint:

Capital One sent my credit card statement to me so that I received it Saturday May 14 and it was due Friday May 20.  I knew it would be impossible for the US postal Service to guarantee me that they would get the payment to Capital One on time.  So, I decided to call Capital One to get a mailing address for a payment.  They don't want to publish on any of the credit card invoice addresses outside of the P.O. Box number.  Remember, the US postal service will not deliver to a P.O. Box number overnight.  Well, I paid big money on May 17 to ship off the monthly payment to Capital One which was guaranteed to arrive before Friday, May 20.  On June 1, I received in the mail my new Capital One credit card statement and sure enough, I was assessed a $29 late fee.  I called the Post Office because I had both my receipt of payment and receipt of mailing.  I was told it was delivered to the address provided to me in the state of Washington on May 19 - the day before it was due.  When I!
called Capital One to inquire why I was assessed a late fee, I was told it was not received until May 24!!  You can imagine my puzzlement.  I confronted the bank rep with the postal receipt number and information of receipt provided by the post office.  She said it was received late.  I disputed it and she reluctantly agreed to remove the $29 charge.

In short, this company is unethical.  More and more banks are attempting to improve earnings by assessing late fees.  How do they do this?  They send payment invoices through the mail LATE.  Then when you try to send the payment via the Post Office, they provide the incorrect mailing address or postal zip code to ensure that it will not be received on time.  These extra "late" charges are great for the bank's bottom lines.

The ONLY way to fight this, is to cancel the credit card.  I am doing so as soon as I get my next statement so I can see that the "late" fee was removed.

Complaint:
Capital One infuriated me such that while hanging up the phone with these idiots, I was reaching for a pair of scissors to cut up their card.

A month or so earlier, I had called C1 to ask a routine question about my account. The representative I spoke with solicited ME for a balance transfer, and offered me a rate of 1.99% for the life of the BT. It sounded like a good deal, so I agreed to take $1500, which she said she would mail to me in the form of a check. She also stated there was a 3% transaction fee, and I agreed to that. I know there is a lot of fine print with cc companies, so I had her go over the exact terms of the offer three times.

Sure enough, within a week, I get the check from C1, deposit it into my account and proceed to pay off a few smaller accounts at higher rates. All is fine until I get my first statement, which bears an interest rate of 18.99%!

I immediately called C1 and told them the whole story. The rep I spoke with basically said there was "no record" of their offer to me and that they "don't even offer" that rate/deal! Incensed at essentially being called a liar and/or crazy, I asked to speak to a supervisor. After going through the whole scenario with him, including asking him to find out who the rep was that I spoke with (I work for another financial services company, and on our system whenever anyone goes into a customer's account, their id number is recorded) which he claimed would be impossible. He also basically told me they don't offer that rate and that there was nothing he could do - they refused to lower the rate to the rate I was offered (unsolicited by one of THEIR representatives, mind you!), or to credit the interest they had already charged me from the time they SENT the check (not when I cashed it) until I paid it off, as I said I would be doing momentarily.

At this point I was completely enraged, and told the "supervisor" that I would be paying this account off asap and closing the account. I took the money out of my savings account and paid them off the next day.

The stupidest part is, I just got an offer in the mail from them the other day offering, imagine this, 1.99%. But wait, they don't even offer that rate, I must be hallucinating or hearing voices again. They have yet to close my account, as I just checked my credit the other day and it is still showing open.

I'm sad that David Spade hocks this no-servicing waste of plastic...David, when your contract is up, don't renew it!!

I have three capital one credit cards and all three have exhibited the same tendancy--to maximize the number of late payment fees.

I mailed the last check to them on June 6, 2005 for a June 16 due date. They claim the check arrived June 20, 2005 and charged a $29 late fee.

Anyone who has mailed bills through our postal system knows that a  domestic 10-day delivery time is EXTREMELY unlikely.

I paid off the balance by phone and closed the account, looking forward to paying off the other two credit cards ASAP.

I encourage any Capital-One customers to do the same--they are they biggest thieves in the credit card business.

June 2005
I have never had so many problems with a credit car company.
Problem #1-Made an online payment 2 weeks before the due date because I was going out of town. I returned home a day after the due date and checked online about my account (due to problem #2 see below). Anyway that is when I noticed they never credited my payment. They charged me a late fee and doubled my APR. They refuse to fix and say they will call me back and NEVER do. They are rude and are the worst credit card company out there. They basically said I was lying about the payment even thought I gave them time date etc of the payment.

#2-I have been having a billing issue with a gym membership I cancelled 4 months ago and I have all the documents to prove I cancelled it. They keep saying they will dispute the charges but there is nothing more they can do. Then they say well you didn't word your cancellation correctly. Now I wrote word for word what the gym advised me to write on one letter of cancellation and then one letter with the words capitalone advised me to write. They then say they will look into it and call me back...guess what---no call back. I even spoke with a very nice ladie about the whole thing who promised me she would follow up to make sure I had received a call back..she didn't call either. Maybe their outbound calling lines are broken--hahah!!!

I need to find another credit card company that actually likes their customers and are on their side!!

Please avoid applying for this credit card...I find it ironic that they have those "no" commercials out there about "other" credit card companies...cause I almost swear they are talking about themselves...because they say NO more than my little daughter!!!

I cannot say enough bad things against Capital one.  Stay AWAY!  I've finally resolved all my issues with them (no time to elaborate), now while trying to even CLOSE this account, they say I have a $.05 credit- so they cannot close the account.  Once that's resolved, they claim I have to wait a full billing cycle with no balance (yes- the credit is considered a balance), before they will close this )($#@&_*)$@&_)@#*&$ account.

This way I might use the card and stay with them (where did that credit come from it was NOT a credit form a retailer.  It was a mis- calculation of their "resideual" interest charges.  How convienient for them.

I cannot seem to CLOSE this account!!!!

Stay away from Capaital One. btw- I have very good credit.

I have always been leery of credit card companies that send pre-approved applications in the mail.  My wife, however, was suckered in by Capital One's offer.

As much as I love my wife, she's quite irresponsible with credit.  She used her Capital One card for cash advances and purchases and by the time she received her 2nd statement, she was over her limit.  Regretfully, that's our own failing.

Capital One, a true financial predator, pounced on her.  They charged her the annual card fee... interest on the purchases... interest on the cash advances... a steep fee for being over the limit... a fee for each cash withdrawal transaction... AND another fee for the "privilege" of cash advances.  All told, there were over $65 just in service charge fees!!

I was livid, my wife was remorseful, she saw the error of her ways and we immediately cancelled the card.  Since then, Capital One has been dangling carrots before our faces, trying to entice us back.

After reading many of these posts, however, I will be vigilant for the annual service charge... even though the account has been closed for months.

Complaint: Years ago I had no choice but to use my credit cards for dental bills(about $7,000.00) and to fly out of the country for a death in the family. I tried hard to pay these bills. But when it got to where I didn't have enough money left for the basics after making payments I was forced to file Bankruptcy. Before doing so I did try credit counseling but they were not able to lower my monthly payments. Sometime after my bankruptcy I got a pre-approved offer from Capital One. I wanted to have one credit card so I accepted even though it had a $59.00 annual fee. Believe me folks I did learn from my first mistake. So for the last four years I have charged very little and telling myself when I do I have to be able to pay it off in two months or less. For the last six months or more I have been getting offers from Capital One. All these offers had a lower annual fee than my $59.00 and several had NO ANNUAL FEE. So, I decided to write Capital One a letter. I ask them since I!
had been a customer for several years and was in good standing with them could I be given a card with no annual fee now. Of course the answer was no, that for my reference my account terms include a membership fee(annual fee). Their suggestion was to cancel my account if I wanted to avoid paying the fee. Isn't that just great customer service? They would rather loose a customer of four years than give me a card with no annual fee now. So I intend to cancel this account which I hate to do as it leaves me without a credit card. Of course after reading all the horror stories on here of what has happened to people that "tried" to cancel their card I fear what will happen to me and the credit I have worked hard to rebuild. I do feel that reading all this helped me to know better what to try to do so that I don't have a major problem(at least I hope). So thank you to all of you that were so willing to share your misfortune and best of luck to all of us.

Capital One Credit Cards make City Bank seem reasonable.  My limit on my card is $300.  They post payments more than one business day after they are made although they say if you make it after 6:00 p.m., they will post it the next business day.  I have had an experience where I have gone over by a few cents and an over the limit fee is charged the next day- 3 business days before payment closing and I don't know about it.
As soon as this happens, even if your account is on time, they send it to collections.
I just spoke with someone I tried to negotiate this with and she was terribly rude.  I really think they border on illegal behavior.  obviously, they get away with this, but I am wondering if it is for longer.

My husband and I have separate Capital One cards that we got in 1998.  We never had any complaints about this card until the last couple of months.  In May, I received a statement for $19 for the annual fee.  I had not used this card in over a year and had a zero balance.  I called Capital One to get this fee waived.  I had done this in the past with no problems.  Well this time, they refused to waive it and the customer service rep was very rude.  So I paid the fee and decided to use the card to get the remaining 200 miles I needed so I can cash out my mileage then cancel the card.  I used the card a week later for dinner costing $18 and then went to Camping World and spent $130.  We decided to buy a tv for our new trailer at Best Buy just after those purchases.  Well my card was declined.  On my way home (with my husband driving) I called Capital One about the problem.  The rep transferred me to security and she was the biggest B***h.  She basically said my card was red f!
lagged because I went to a restaurant and then went to a sporting good store.  She said it was red flagged because a lot of credit card theft happens in restaurants.  I told her that was a weak excuse and said "So if I happen to use this card again for dinner and then use it to go shopping, I have to call you let you know of my intentions and approval! She said Yes"  I was appalled to hear this.  I have over a 800 FICO score and always been responsible for my debt.  This card was paid off, my rewards received then cancelled.

But this was not the last of Capital One!!!

My husband paid his bill in full through billpay on a Thursday morning and the money was transferred to Capital One on Friday.  Well he called a week later and found out he was charged a late fee and finance charges. Found out that they did not post his payment until Monday (the next business day)  Needless to say he tried to call them and went through all the automated phone service and couldn't get to a real person to straighten it out.  So needless to say, he will pay it off and cancel it.

They don't care about their good customers and trying to keep them.  They just treat every one like they are in terrible debt and can't pay their bills.

I wish I knew about this web site before I applied for these cards.

I got a credit card with capital one several months and set up a direct debit to pay the bill in full all was ok until last month.

when my bank bounced the credit card payment the account was short about 10 pounds. so i got a Ł30 charge from the bank and a Ł20 charge  from capital one the balance due was about Ł49 so i paid them direct Ł95 to pay of last months balance and also to keep this months payment down to about Ł105. ok i accept i did that to myself but i cleared the balance owing right and then some.

well this morning they tried to take Ł200 from my account
and succeeded in bringing it overdrawn by Ł25 which meant the bank bounced it this now means a further Ł30 charge from the bank plus a further Ł20 from capital one" however my total balance on this card including for next month is Ł130 and right now my statement online says my balance is 69 in credit to me in other words they have Ł69 of my money.
obviously when there systems realise they didnt grab my money successfully
i will be back to Ł130+ Ł20 direct debit fee from them owing.
I am so angry both with them and the bank so now i aim to close both the card and the bank account.

The way this company work even in the uk which has regulation is evil
I just hope closing the account is not as difficult as it seems to be in america.

Don't Do Business with Capital One

I found Capital One to be deceptive and sleazy.  They are holding my good credit hostage.  I spent years building up credit with a Capital One Credit Card.  They say they don't report that type of card. I believe that they do this so you can't go elsewhere.  They created difficulties to keep me from closing the account, even though had I paid it off in full.  They kept it open an extra two or three months by playing games.  They claim that they got some of my payments late, although they probably should have gotten them in time.  After reading about other people having this same problem, I believe that they lied and said they received the payments late to charge me for late fees that I did not owe.

The workers you get on the phone may have beautiful manners and seem to be so classy and apologetic that you will have a hard time believing that that the company is so sleazy.  The workers not be fully aware of these things themselves.

There seem to be more than a few people experiencing difficulty having their payments posted as they should be.  If you are trying to close your account, your might want to watch them playing games that might prevent that, like giving a pay off balance as of a certain date (far enough in the fututure that you feel your check should have arrived by them).  It might turn out that somehow your check didn't quite make it by that date and the tiny amount of interest charged has caused the account to be open for another month.

Another thing to be aware of, is that unless things have changed, they have a lot of their phone service workers in India, and they are useless.

Ignore all those Capital One ads (maybe the income from ads are the reason they don't get exposed on the news).  This is a sleazy company.  If I had it to do over again I would get a card from a large, reputable local bank.  They are generally less apt to do these kinds of things.

Another thing to know is that the Virginia Attorney General's office might not accept your complaint against Capital One. There is another Virginia agency, I think it's called the Office of Thrift Protection, that is supposed to have supervision over this type of company.

I wrote a dated April 6, 2005 for $4000 to Capitol One Bank. This checked cleared my checking account for $400 on April 11, 2005. I called my bank and on April 21, 2005, they promptly issued a credit of $400 and then debited the correct amount of $4000 out of my checking account to correct the discrepancy. Since Capitol One failed to catch the error, I had to contact them myself about the problem and mistake on my credit card statement showing the $400 payment instead of a $4000 payment. On May 10, 2005, I was told by the Payment Investigations Department that Capitol One's bank, Bank of America, had committed an encoding error and that is why the payment was recorded on my statement as $400 instead of $4000 and thus why my check cleared for $400 instead of $4000. Since Capitol One showed they had received payment for only $400 and my bank cashed the $4000 check for $400, my bank promptly forwarded $3600 to complete the $4000 dollar payment I had originally sent. A represen!
tative from accounting at my bank reported to a Capitol One Customer Relations Department superviswor on September 6, 2005 that my bank had indeed sent the $3600 on to their Clearinghouse to complete the payment to Capitol One on April 26, 2005. I am still getting billed for this $3600 and cannot get Payment Investigations to return my calls and get this problem resolved.

Complaint:
I have had two credit cards with Capital one for over a year now. I live in Albany, NY and used to send my payments to a Virginia post office box. About 5 months ago they changed the address for payments to St. Louis MO. I mail money orders to them so I have no way of checking when they were cashed. Each month I mail the payments on the same day from the same post office at the same time. Since I have been sending the payments to st louis, I have had 3 months of late fees on each card. I have the 2 payments posted on different days, always past the due date although I am sure that I have mailed them in time. They keep blaming the post office saying that I need to allow at least 10 days for the post office to deliver the mail to them. They assure me that the payment is posted on the day it gets to the post office. I can mail payments to california for my car and the most it takes is 4 days to be posted, but apparently it takes 10 days to st. Louis.

I have called the post office in St Louis and they have had numerous complaints about Capital one and apparently they are compiling names or something. I have found a nice woman that works at the post office that has agreed to receive a series of mailings from me and document when they are received so I can prove it doesn't take 10 days to get a letter from here to there. I have also found out that Capital one is regulated by the State of virginia Banking Department and will handle all complaints against this company no matter what state you live in. I would hope that all the people that are having problems with this very disreputable company (in my opinion) will send an official complaint to the virginia banking department. There is strength in numbers and a large very wealthy company- they have to be wealthy as they have charged me $180 in 5 months in late fees- can certainly defend themselves against 1 or 2 complaints but thousands or more may be a different story.

If all the complaints I have read on this website are true, then capital one needs to be sanctioned for their business practices.

Thank you for allowing me to vent.

Complaint:
We mistakenly encouraged our 18 year old son to get a Capital One credit card when he was solicited by mail. He was leaving to do missionary working with the poor in Mississippi for one year between high school and college and we felt it would teach him about credit and as well as give him a back up in case of an emergency. His credit limit was $300. When his year in Mississippi was up he came back home and enrolled in community college. Part way through his third semester he had an accident which forced him to drop out of school for health reasons. His bills piled up and between doctor visits, insurance claims, and red tape with the school, we overlooked his Capital One bill. When we did see the bill, it was over the limit, not because of purchases, but due to late fees being assessed. I immediately called customer service and closed the account. After explaining that I would be willing to pay off the entire balance if they waived the most recent late fee, the person I spo!
ke with agreed and gave me the payoff amount which I paid immediately. A month later I got the Capital One statement and the late fee remained on the account with another late fee charged in addition to that.  When I called to follow up - surprise - there was no record that I had spoken to anyone about the account although it had mysteriously been closed on the date of the original conversation. They told me I would have to go through an appeals process to have the late fees waived. Of course we received a letter in the mail a couple of weeks later saying the appeal had been denied.

The problem with dealing with companies like Capital One is that their customer service reps are not really empowered to do anything. Instead of working with the customer to reach a satisfactory solution the customer service agents seem to only have power to make quotes from the "rule book." Instead of being grateful that the responsible parents of a sick college student were willing to pay off his debts, they created a mountain of "bad will" by insisting we pay additional charges created, not even by using the card, but by their own fees. We paid off their fees but you can be sure that I'll research all future credit opportunities and boycott anything connected with Capital One as well as tell my story to anyone willing to listen.

Recently I reduced my credit limit on my Capital One credit card from $5000 to $3000 as was advised by financial experts on the Today show to be less vunerable in case of fraudulent charges.  Well, unbeknownst to me, I received my statement and was charged an "over limit" fee of $29!
I couldn't believe it!  I thought your limit was YOUR LIMIT, and if you went over it, the card would be declined!  But since they want to be "nice" to you, "in case it's an emergency", they extend your limit, then charge you $29. for being so "nice"!  When I told them I was not told of these "over limit" charges when I reduced the credit limit, I asked for them to waive that charge. They said that they couldn't do it! I then spoke to a supervisor who said "No!".  So I canceled the card.
BTW, I always paid my monthly statement off in full each month for 4 years straight with only one missed payment!  Now, I can say: What's NOT in MY WALLET!"  Thanks for being so "nice" Capital One!  Other cardholders....BEWARE!

Complaint: DO NOT USE CAPITAL ONE. CAPITAL ONE WILL NOT BACK YOU IF YOU LEGITIMATELY DISPUTE A CHARGE!!!!!!  I disputed a $70 charge for a hotel. The room was filthy along with all the linens. I call CapitalOne and dispute the charge. They deducted the charge from my bill and sent me a letter telling me to provide my name, account number, details of the incident, etc. I mailed my letter in in Nov 2005. A couple of days after this the charge reappears on my bill. I call back and they tell me, get this, that i have to have a third party letter from ANOTHER HOTEL'S MANAGER about the quality of the room. Uhhhh, don't forget that this is like 2 months after the fact. They will not take the charge off until I mail them the letter. Ridiculous. The customer service and investigative solutions dept are one in the same, i can say that for sure. I dont how to go about stepping this up to the next level.

I have been  customer of capital One for five years and have never been late on a payment.  I carefully ensure that I pay my bills on time if not early.

I received a letter from capital One stating that I was late on a payment and that my 14% interest rate was being raised to 28.5%!  I had no idea credit cards could charge that much.  Afer five years of a solid payment history my rates doubled to nearly 30%.  When I contacted the customer service representative I was instructed that after 8 months the account could be reviewed to see if the interest rate could be lowered.  The representative seemed to be reading the rules from a script and any attempt by me to have him look at this as an individual case was unsucessful.

Needless to say I am not waiting the 8 months.  Thankfully I have the resources to pay off my balance and move elsewhere.  Interestingly enough, when I caled back to pay by phone ( I wanted my payment credited instantly), the charge of the call was $10 (it would be more if i spoke to a person)

What's in my wallet?  Not Capital One.

Re: Not posting your payment on the day it's received -- Federal law requires credit card companies to post your payment on the date it is received.  If they fail to do so, they cannot assess you late charges or added finance charges.  Still, a common tactic most card issuers use is to post only those payments received by 9:00 a.m. or 3:00 p.m. on a given date.

I was paying my Capital One credit card payment on line, on time andkept receiveing an "error" page everytime I tried to submit my payment.I called Capital One, informed them of the situation, asked for help. I received an assurance from not only one, but two customer service reps that no late fee would be assessed since my pmt. was rec. by 2:30. A weeklater I saw that a  $35.00 late fee was assessed. I called again and was assured that it was an error and that the fee would be removed withinn 10 bus. days. Today I received a letter stating that the fee will NOT be removed. I have 5 Ca[ital One accts: credit card, Auto Loan & Home Equity all in good standing. There is no reason to be lied to by this company.

Complaint: I missed a Capital One card payment in January and assumed I'd just pay online before the next deadline in February and I expected to pay a late charge as well as my monthly payment. But on February 10th I received a call from Capital One requesting I pay $68.00 just then over the phone and they would drop the late charge and other fees. I agreed and made the payment but my statement was never changed. I called to inquire and they told me that they needed to review it and would decide in about two weeks. I checked back with them a couple of weeks later and they rejected removing the fees as their representative had promised earlier. What I don't understand is that they called me and made the offer. Has this happened to anyone else?

As a longtime customer of Capital One, I had decided to close the account when I noticed that the finance charge was nearly 28%.  I mailed the balance as stated on my bill and asked that the account be closed.  The following month I received another statement indicating the balance had been received prior to the due date, but I was charge an additional 22.00 finance charge.  I called Capital One and was told by the rep that the balance on my bill was not my "real" balance and I should have called in to get the correct pay off. After a lengthy conversation, she finally agreed to credit the 22.00 and close the account.  A month later, I receive another bill.  This time the balance is still there plus a late charge.  I call again and speak to another rep who repeats the same well versed explanation and advises that my credit will be ruined over 22.00 if that is my choice. Since that conversation, I have written to President/CEO Richard Franklin of Capital One in an attempt to !
rectify this situation but have heard nothing. Capital One is threatening my good credit in an attempt to extort any nickel and dime they can.

Complaint:
I have had Capital One card for several years now and I used to feel a loyalty for them as they gave me credit when no one else would. Basically this is the only reason I keep them around. I now however feel that my loyalty was misplaced afterall. The first thing I would say if nothing else is DO NOT go to them unless you have no other choice. Orchard, Household, and Providian, to name a few are better to rebuild with if you can get them (they report limits). Capital One will "tank" your already low score the second you use them, even for a $1.00 charge. Why, becuase they do not report limits on purpose, to trap you with them. You will look like you have 100% utilization. The other high risk cards will generally report your limits. If you have no other choice then buy a big ticket item, close to but not over your limit, wait for the next reporting period and then return it for refund to the card. This will cause the credit reporting agencies to use your high balance as your!
limit, improving your score vastly. Then in little time you will qualify for the above cards.

Second, DO NOT trust their reps, which you can get to by hitting *# then *# again on their cust svc line. I have very good credit now as I have BOA plt rewards, Chase rewards, USbank plt, Dell, and home depot. My mortgage is at 5.1% fixed and my score is high. I keep telling myself I keep them year after year because they helped me (after I helped myself) however no longer is it worth the HASSLE. I called to close it in 2005 since they are my only annual fee card. They waived the fee so I held on another year. I called before the fee hit in January and was promised it would be waived, low and behold it hit in March, I called again in March and was promised it would be waived when I was given the $115.35 payoff, and again it didn't happen. I call today and was told they couldn't waive it. Why do I keep you? Why do your reps lie?

Complaint_against: Capital One Business Credit Card

Complaint:
I have a Capital One CC with my Business name & my name on the card. The limit is only $500. I did a balance transfer from my other personal credit to pay this account. I made a mistake & transferred $5,000 instead of $500. The account has a credit balance of ($4,500). I asked that the money be returned to the other Credit card that initiated the payment. They said they can't do that and they could issue me a check. It would take 30 days for them to process this refund and another 15 days for the mailing time. This is a refund, so it should be processed as soon as possible. I was paying interest on this balance transfer. After being transferred to many account specialist nad being on the phone for more than 30 minutes, one acct specialist finally said they will process that within 7 days. The account was closed on the 8th, they mailed the check on the 16th and I received it on the 22th. It was payable to my business name.

I would not want to cash it on my business name & issue myself a check from the business, since It would look like a draw on my business. I called Capital One on 5/23 and told them I need to have this  check issued under my name. Since it is a business, they said it will be issued under my business. I told them they could put it under the business name & my name. They said they could do that, and it would take 30 days for them to process this again. This is a replacement check and it should not be that long. It is just voiding the check, re-issuing new one and sending it to me. It does not need approval.

I don't know if it is legal for them to keep other people's money that long, almost 45 days(30 days for processing & 15 days for mailing). With Capital one, even when the process was through ACH (from my Citibank CC), they said they have to wait for it to clear. You do not clear an ACH. Besides, they recieved that ACH the first week of May. With my other credit cards, like Citibank Visa & MC, if I make an overpayment & I paid with a check, they will tell me that they have to wait for the check to clear before they could send me a check and normally, I would receive the check within 10 days. It seems like Capital One wanted to make some money by earning interest on it.

The "No Hassle rewards" are a big hassle, as if you try to get Cash, they cut your reward in half!!!!!!!!!!!!!!!!!!!!!!!50,000miles you get $250 instead of the $500 you might have gotten if you use them, on airline tickets, but be sure, even with that, to play by their rules, which are designed to beat you out of your "NO HASSLE MILES"!
On the Credit limit side, Watch out, as they let you go a few dollars over your credit line each month, as this allows them to collect and extra $29!!!
Keep two eyes open with this Bank!!!!!
I had a card stolen and they do not allow you to transfer the miles that you have earned to the new card!!  Real NIce!!
This is not a nice Company to deal with!!
They are Foreign, so try and American Company!!

Capital One is sending promotion material with very midleading messges. semantics. Consumer Beware and don't be fooled they have a policy of charging 'Finance fees' AKA "Late Charges. If you miss 1 month's payment Capital One will charge you late fees for the next 2 months despite paying those future bills in full. The "Finance Charge" is a penalty you'll pay until you have 2 consecutive on-time payments. Yes, they tell you about this not on the front of their promotion materials but on the back of your charge statements. The part that is in small print.

They are the most difficult company to contact, a menu that may not cover your situation, no directions to reaching a customer Rep. and very inconsiderate customer service.

Do Not Deal with Fraudalent Capital One, Close your Accounts

I reported credit card ending in YYYY as missing on April 28, 2006.  I spoke with Matt and Kyla, who closed the account.  This account had been used only for a gym membership,  $26.95 per month.  That membership was ended, 26.95 paid on-line on April 17.  A final gym bill of $10.00 was paid on April 25.
I realized the card was missing, and reported it as such on April 28, as mentioned.  When I received a bill for account ending in XXXX, I contacted Capital One again.  This bill was for a Capital One membership fee.  I explained I did not have a card ending in XXXX (spoke to Dan on June 12), who closed the account.
I located the card ending in XXXX, which to this day is still attached to the paper it was mailed in.  As explained to Dan, I have never seen a credit card sent in the mail without an activation sticker!!  There is no proof I ever received this card, and Capital One sent me a membership bill!  I received another bill, with late charges!!  Before speaking to Shayla, another operator insisted that I owe the $10.00 from account YYYY, which I paid on April 25.  Apparently this $10.00 was transferred to XXXX, but it was already paid! Then he insisted I get proof of the $10.00 payment from my bank (which costs almost $10.00 to do).  And on top of that, they continued to charge late fees for the unpaid membership fee for a card they can't even prove I ever received!!!  This is when I finally spoke to Shayla, Operator ID HV61.  (Besides the fact that every single phone call I have to speak with at least 3 different people and explain the same story over and over).  My account ending in XXXX was closed via telephone, with Capital One manager Shayla, Operator ID HV61.  She confirmed the credit of all pending charges, ($108.47), no further charges, and that the account will run at a zero balance for one cycle before final closure.  Keeping my fingers crossed........
This is despicable business practice.  I will never deal with that company again.

August 2006
I applied for and received a Capital One card last month. They do not send you a "Terms and Fees" disclosure as other cards do. They send a "Customer Agreement" which has only general statements. Don't be fooled as I was. Get a copy of the real terms and fees before you activate you're card. I only realized this after being charged $5 for two ATM withdrawals ($20 each) for $10 total. Plus $1.33 FOR SOME INSURANCE ??. Plus $19 annual fee. I applied online for a no annual fee card, suprise this is a different offer. My second payment of $24 was returned and I was given and over the limit fee $19, and $29 "returned check" fee, but I payed online. Hhhmm. Talked to a customer rep. for 40 minutes(press random buttons until the system prompts you for a social security number-very professional). No help. That is $59.33 in fees in 45 days. Worst credit card I ever had. I wish I had researched the company. I was lured by a wealthy company with such a huge advertising budget. I'm goin!g to try and cancel. I'm scared.

Score Crushers

I have four cap one accounts. All credit cards. never late with them or any other card company. I pay very close attention to my bills etc. I have been working very hard to increase my score over the years. I have numerous (13) credit cards. Several with $8,000 to $10,000 limits. Cap one's are less than $2,500 along with a mortgage and such. I have always used and kept Cap one's open because they were my oldest listed credit granter.  My score was rapdily approaching the 740 mark. then for some reason it dropped like a ton of bricks and my cap one interest rates climed to rape levels (23.99%). None of the others did. I spent the usual 50 bucks and got all three credit reports and score. My score was 670 and nothing had changed in my file. So I thought....I could not figure out why such a decline based on my online reports. everything looked ok. I decided to write to the credit B's and get a copy of my report form them instead onf the online version.  What a difference.... The "online version" listed my high/limit in the same field. That's why I didn't find the problem at first. The written version told a different story. This one showed a high limit spent (which is compared to your credit limit) However, there was not any amount listed in the "credit Limit" feild. It was $0.  This move, reduced my available credit by $10,000, and made it look like my overall credit to debt ratio was in spin dry. I called today and cancelled all of my cap one accounts. I applied for an Amex Optima Plat card and was granted a card with a $10,000 limit. This one card will replace the four cap one cards and my debt to credit ratio will be much better.  Stay away from Cap One. they will rape you... Prisoners at GITMO have been treated better tha Crapital One customers.

On 29 Aug 06 I called Capital One concerning the amount of requested payment for my credit card.  The representative on the phone (Candice) informed me that their computer system was stating that they have not received a payment to my account since Mar 06.  I explained to her that I have been making payments all this time and she got me in contact with the payment investigations department.  This department informed me to have my bank send information verifying this.  I contacted my bank (NFCU) and authorized them to send my statements to Capital One and also contacted Check Free Corp who handles Navy Federal's online web billpay.  This information was faxed to the payment investigation.
One the 3rd of Sep I called back to the payment investigations department and asked them the status of the investigation.  They said they had received everything and that I should be hearing from a manager by the 8th.
After the 8th rolled around and I hadn't received any phone call, I called back to Capital One and talked to John.  He stated that in the notes of my account it was listed that my 4 past payments had posted to my account at around 0730 that day and that within 24 hours it would post to my account.
On 19 Sep my wife attempted to use my Capital One card and it was denied.  I called back to the company and explained to them everything that was happening and was told by Javier that the system is now showing that they did receive the payments when they were sent and that the report that John gave me about payments being posted at 0730 on the 8th never happened.  I explained to him that I was their system that stated the payments weren't received and that is why everything happened. He explained that no payments were posted to my account and I still had my past due payment outstanding and that's why my account was closed.  I explained to them that this was not the first time payments hadn't been posted and his company was the ones that were messing up my account.

I canceled my capitalone credit card with zero balance on it on 8/7/06. I was out of country on vacation for a month. Came back and checked my mail; I had a mail from Credit-Inform  saying that I was enrolled in this and also sent some kind of Certificate of Insurance.  The booklet I got with it said like this " Congratulations You've taken an important step toward managing and protecting your credit by becoming a CreditInform member during a telephone conversation with a Capital One agent !!!" See the thing here is I canceled my Credit Card through Automated Telephone Service and it didn't even has the option for enrolling into Credit Inform.  First my account was not closed even till one month to 40 days after I requested; Second they were charging me with CreditInform enrollment recurring fee of $5.99;
when I called customer service; they are saying it might be some software bug that caused this to automatically enroll me to CreditInform.  I say Capital One is Number One Fraud.

Capital One based in Dallas, Texas.
This is the second time I've had issues with this company, it was three years ago; the first time I'm thinking it could have been me. In talking to others with the same issue, when it happened again. I was mad.  My payment was due on the 26th. I pay off the balance each month and I purchased and sent my bank cashier's check (no "beat the bank" here, the money exchanged hands) on the 19th. Capital One posts the payment on the 26th. I call the Post Master and she says it's two days to Dallas. Even if the letter sits around the post office for a day and a Sunday is involved...there are three days to get to Dallas and be posted. Capital One poats five days later.
So I call to ask about resolution. The reply is, basically, if you can't prove when it got here, then it got here the day it posted. I'm responsible for when their people post. It makes no sense. They can just autonomously add late charges and affect your credit rating any time they need to improve the bottom line. "Here, just hold these a couple days and soak 'em for late charges. And the is no recourse.

I sent my last payment in June and asked to close my account. I didn't speak to anyone on the phone because the last time I did it cost me $39.
Another $39 because I got diconnected. So I sent them a letter.I got nothing in July and then they charged me $19.99 for a membership fee.
I ignored it because I thought it was closed.Nothing in Sept. Then I
get 2 late fee notices. So I call and complain. They say I had to call to cancel my account.I asked if they would accept the membership fee and close the account. They said they would accept that and wave the late fees. Now the story has changed. They won't close the account until
I pay the late fees. Can they do this?

I had Capital One Card since December 2004.The interest free period was promised me by that card for 6 months. On Jan2, 2005 I had paid my min. pmnt and have called them to help me to arrange my next one, since I was going oversees. I was told that It would not be a problem. Since I will be back on Feb6, just a day after my due date. I was leaving USA Jan5, and my check for next due date would come too early. All of that I have heard from the person from the customer sevice. However, when I came back and paid IMMEDIATELY! I had late fees and lost my interest free privilleges. Wait... It gets better and better...
On June 2006, I had paid, in my usual manner (citibank-to capital one online payment)$100.That had never been credited to me, I've gotten late fees and extermely rude person on the phone, refusing to give me her ID#.My Bank send them a proof of transaction, and I've gotten a copy. Oh, CapOne had not received it! (Hard to belive, since I had received my copy.) Next months-$50. Same story. In August I had managed to fax their investigation department all the supporting docs.I was credited $150. (Never any late or overlimit fees)... But not for long... next month it had shown back on my statement along with late and overlimit fees. After another frustrating conversation,(never ID# given), again, I was told that they have never received it and credited me in advance (what a nonsence!). Ever since I have been harrased by them on the phone. No single person agreed to give me ID# (since they call me a liar, I want to complain...)This causes me great amount of stress.
We all should do something about this credit card indecent, fruadulent and dangerous behaviour, since it is hearting our credit and causing nervous breakdowns. What about filing a collective lawsuit? I would take a part of it!!!!

Complaint: My first credit card EVER was with Capital One as a sophomore in college.  I was making the minimum payments until graduation and I then set up a payment plan with the collection agency ARROW FINANCIAL (Niles, IL).  I paid them over $1400 of my $4000 debt.  I then moved to the east coast for grad school and was told by Arrow that they were no longer managing my debt since Capital One was not satisfied with how it was handled.  Next thing I know, I am am the phone DAILY with customer service at Capital One trying to find out where my account is so that I can continue paying it off.  CAPITAL ONE DIDN'T KNOW!!!!  It took me two weeks of calling daily, bouncing from department to department, until finally I reached someone in collections who referred me to the agency that it was transferred to.  I got a voicemail for the first week that I called and when I finally spoke with a person at the office, they told me that when Capital One transferred my file to them, not on!
ly did they reinstate the interest (25.7%), they also tacked on a late fee AND attorney fees.  My $4000 debt which I had reduced to $2600 with payments had now ballooned to over $5300!!!! WTF?!?  They said that there was no proof that I had made payments to Arrow Financial.  I faxed them over my checks as proof and then they proceeded to tell me that Capital One had no proof that the money I sent to Arrow was transferred to them.  What can I say, everyone I have dealt with makes me feel like they don't know or want to know what is going on!

Complaint_against: annual membership scam

Complaint:
Capital One sent me a bill for an annual fee - I had not used the card in almost a year due to shoddy customer service.  The membership fee is 19 dollars -  So I called customer no service and finally after being on hold for ten plus minutes - a customer service person listened to me about the fact that when the account was open there was no annual fee - and that I do not pay an annual fee - I asked her to close the account or wave the fee.  She promptly said that she will send in a request to wave the fee and that I should see the credit on the next billing cycle and thanked me for being a valuable customer.  So my expectations was that I would not see the fee again. The next months statement comes in and low and behold not only was the 19 dollar annual fee was there but a 29 dollar late fee was there and now I  was in the hole for 48 plus dollars.  Keep in mind that is the only charges on the account. So I call Capital One again and got put on hold after having to punch my way through a long list of automated self service functions.  After 20 minutes of muzak - a customer no service person came on the line (this time I am asking for names and ID numbers).  I explain what happened on the last call when I first received the annual fee and the customer service person said it would be waved. So this person looked up the activity on the account and said there was no record of the call.  At that time I said that I was on my phone activity and gave him the date and time and duration of the call - license from the other end - and period of 2 or more minutes went by and he finally spoke and asked if he could be of service.I promptly stated that he could reverse the 48 dollars and we could end this call and go on with our day.  He then said that he had put in a request for the reversal and that it should appear on my next statement.I clarified what he just said - my expectation was that the charges are reversed and I no longer have to be concerned about the charges.  He said that it was a request and that a supervisor would have to OK the refersal. So in my mind I felt that this was very misleading and that I would in all likelihood be hit with even more charges and the game would be come more intense and there bedside manner was not getting any better. So I asked to talk to a supervisor.  Once again I go on hold and when the supervisor came on line - once again I related my side of the business relationship.  He advised me that they do not wave annual membership fees - my question to him was ----  why then did not only the first customer no service person lead me to believe that it was a common practice and that it would be removed --- but -- the second customer no service person did the exact same thing and if I had not asked to talk with you - I would have been hit with more late fees and a possible blemish on my credit rating (which by the way comes as a threat in the bill if it is not paid now!!)The supervisor said he could not speak to that issue. Now how lame is that - by now it is clear to me that Capital One screws with there customers because they must believe that their customers are not smart enough to figure the scam out.So I got the supervisor (his ID number) to agree to close the account with a zero balance .So the supervisor read me a disclaimer that said if I were to use the card within 30 days the account would automatically go back as an active account and that all the fees and late charges would be reinstated and I would lose all my rewards points.I agreed - and felt that the reward was not having to do business with them again.I will keep my fingers crossed so that my final statement comes next month and I no longer have to deal with a credit card company like capital one.

Complaint: My problem with Capital One started when I lost my card.  They issued me a replacement card no problem and I was told all of the information from the old card would be automatically transferred to the new card.  I had made a return to Bloomingdales for $300 which was put credited back to the card I lost.  When I waited 2 months and did not see the credit on the new card I called.  First annoyance I encountered is that there is no option on their menu to speak to a representative.  I kept hitting "0" to no avail. I did this for 10 minutes until I figured out the trick was to do nothing and wait and then you get transferred to a rep.  How does a company who is supposedly the "NO hassle" card not make it convenient to speak to a rep??  Ok, well that's just the beginning.  I have made 4 phone calls, lasting from 45 minutes to an hour each being transferred from person to person, explaining the story over and over, waiting on hold for extended and I mean EXTENDED perio!
ds of time which I feel is a completely unacceptable amount of time and still being told they will submit it..blah blah blah.  Once I waited on hold for a supervisor for 20 minutes and then it finally went through and rang and rang with no answer, at which point I had to call all over again, enter all my information again, and explain my story yet again.  Today its been 3 months and still no credit.  I am so frustrated that I am going to call one last time tonight and then submit them to the better business bureau.  They are the absolute WORST!!!!!!!!!!!!!!!!!!!!!!!

Complaint:
My husband, Jack, passed away on December 14, 2006 after an eight month battle with liver cancer.  Shortly thereafter I advised Capital One of his death so that his account could not be fraudulently used.  The card was held in both of our names for several years.  I specifically requested that the card not be closed.  The next day I attempted to use the credit card and usage was prohibited.  After two weeks of frustrating phone calls, the restriction was finally lifted.  I've since been using the credit card.
Six weeks later, in an attempt to use miles earned, I was advised that I had "x" number of miles but because of the status of my account, I could not redeem them.  So, the calls started to Capital One, again.  After more than two hours on the phone with countless customer service representatives, I was told that because of my husband's death, the account was closed.  The only way to re-activate it was to deal with the Probate Department.  I've already done that.  It appears that it was erroneously closed by an employee when they saw the words "deceased".
The frustrations of dealing with Capital One have left me exhausted, frustrated and in tears.  Dealing with the loss of my husband of 42 years has been challenging.  He was a great man, husband, father, grandfather, friend and community leader.  I mourn his loss every minute of every day.  I should not have to be dealing with this kind of frustration.
Jack and I shared the use of the account and limitations on the usage of the miles should not come into play.
Phone calls seem to lead nowhere, letters are not answered and it seems that I am at the mercy of a company who has incompetent employess who are uninformed, surly and ignorant as to the rules.  My account should not have been closed the first time.  After it was re-activated it never should have been closed the second time.
If your company can help me in any way to reactivate my card and allow me to use my accrued miles, I would appreciate any help.
Thank you,
Barbara Bayer

I believe Capital One will do what ever they can to rip you off.  I have had a credit card account with them for over a year.  I have carried a balance in excess of 10,000 dollars, and have never been late.  I posted my payment to American Express and Capital One through my bank electronically on the same day (2/16/2007), and both cards were due on the same day (2/19/2007).  American Express recieved the electornic payment the same day I sent it.  Capital One, I believe, held the payment till one day after it was due, and charged me a late fee of $35.00.  When I called customer service to see if they would give me a variance for this minor infraction they informed that it was their policy to not refund late fees.  So I asked if it was their policy to encourage customers to pay off and close their accounts, and to take their business elsewhere.  That still did not work.  I will be closing my account within the week, and I will never do business with this bank ever again.  I !
also would urge anybody considering a credit card to stay clear of Capital One and any other organization associated with this company.Sincerely,

I cancelled this account 6-months ago and still receive monthly member fees and late payments.  I was told by a customer service representative that the monthly membership fee reopens a closed account.  Here is a letter I sent to them.
March 13, 2007
To whom it may concern:
I am very angry.
I closed this account in December 2006.  I received a bill showing a late fee in March for a Capital One Monthly Member Fee of $5.00 and a Past Due Fee of $29.00.
After making numerous calls to your Customer Service department, waiting on hold for an accumulation of hours, and listening over and over again to scripted promises that this problem will be solved, I still have several unanswered questions.
1. Why do you allow a closed account to be opened with a monthly service fee?
2. Why do I have to invest so much time and effort in having an unwanted account closed?
3. If I sent you a bill for my time and effort will you pay it?  If not, can I collect late fees?
4.What will it really take for me to resolve this issue; more calls, a legal threat, a blood sample?
Please, I implore you, stop this "harassment
On this day, I was on the phone, on hold to speak to a supervisor, for over 47 minutes.

Complaint: After receiving my April Master Card account statement from Capital One I noticed my fixed APR of 7.90% was increased to 12.90% variable.  I immediately called Capital One to find out why.  The representative I spoke with said that this was a Capital One business decision and the 12.90% could not be changed.  She said I should have received a notice in my February statement of the increase decision and the information to OPT out.  I received no such notification.  I believe this is illegal and I plan to pursue advice.  I have been an outstanding customer, my payment history is unblemished, significantly more than the minimum payment, ahead of the due date, everytime.  This is just plain wrong.

Complaint: "WHAT'S IN YOUR WALLET"  I hope its not Capital One.  October 2006 I cut up my cards, and sent them with a letter and final payment to Capital asking them to "close" my account. OOPS.  I should have said zero out my account.  My check arrived on the 19th, rather than the 11th.  They  added a late payment charge.  I offered to pay that.  They will only accept payment, (which by the way, as of April has built up to over $180 in interest charges,) if I give them my bank account number over the phone.  If I mail in the payment they will simply deduct it from the most recent amount ($180 plus.)  I get one, sometimes two calls daily from a debt collector who tell me if I had only said "zero out" the account, none of this would have happened. Don't put Capital in YOUR wallet.

CapitalOne Credit Company commits fraud by misleads  people. I have the most horrible experience with them. 1- They send out flyer for balance transfer from other credit cards free of finance charge for a year. This is a big lie and they want to rip you off. They know the way: They will not charge you on the transfer but they will start charging you finance on your purchases!! This was the answer from an account manager after 4 times talking to different managers and all of them were denying the flyer. I have their flyer.
Their managers know nothing on the system.
2- On their statement they show 0 minimum charges. They do not show the total of the transactions and all they will show is New Balance including the balance transfer with no min. charges due, so you will never know how much you need to pay to avoid finance charges. They are crooks.
3- There is no customer service. When you call them there is no option to reach a representative unless you falsely indicate for example you want to transfer funds. One will be on the phone for minimum half an hour or on hold to fail solving a problem for almost an hour or min. 45 minutes. If they need to do research and the client needs to take care of other business after long time conversation, their response is: we can't make calls to out and we don't have direct # if you won't hold you need to go through the Whole process again.  4- Anyone can charge you.  5- They are great at steeling customer money and ruining their day if you get the chance to reach them at all.

Customer Service is the worst I have ever experienced with any company!  Almost impossible to get through by phone.  I tried to call them regarding a fraudulent charge and when I finally gor through, was informed I must prove it was fraud.  I had responded to an on-line request to refill an RX I had ordered from an on-lin pharmacy, and imediately realized that it was not my company.  So...even though I called right away, they would not help in any way.
Also, I would like to say I hope more customer service gets outsourced to India, because they are usually polite and intelligent and I am tired of these companies with slackers who can spell simple words in their native language.  I think Am X and Citibank has spoiled me, so I won't be leaving any time soon.  I have had very good luck with both of these companies resolving mistakes promptly.

I have a credit card with Capital One (Not for much longer though..)
I was sent a letter that initially approved me for $3000.
I was sent a second letter stating that if I made all of my payments on time, I'd get bumped to 3500 dollars. I made all of my payments early, and usually for at least double, if not triple, what was required.
I always maintained at least a 1200 dollar buffer.
I logged in to pay my bill last night and discovered that they reduced my credit by 1365 dollars. For being early. For paying more than required. For doing everything they asked. With no notification. And it pushed me over my credit limit, since they reduced my limit by a third.
I called and asked what had happened. "We made a mistake and gave you too much credit." But you sent me a letter stating I'd get three grand. "Doesn't matter" But you sent me a SECOND letter telling me what to do to get to 3500, and I did it. "Doesn't matter" But I paid everything early. "Doesn't matter" But I've been a very good customer. "Doesn't matter." But it's YOUR mistake! "Doesn't matter." So you do not care that you've hosed me over completely for the summer. "We're very sorry..."
I esclalated to a manager who told me I could not escalate any further, yes she agreed it was the company's fault. Yes, she agreed they hosed me out of roughly 1500 dollars (300 over charge penalty, and then the 1200 buffer I was counting on for the summer), yes she agreed they were treating me awfully and were in no way concerned about actually helping me out. No, she wouldn't put it in writing, no, she won't give me her last name.
Caveat Emptor would be a mild warning in this case. Capital One: Arbitrarily reduced my credit limit by THE EXACT AMOUNT it would require to push me over my limit, never notified me, and then told me there was nothing they could do about it when called on their behaviour.

Don't be fooled by the "what's in YOUR wallet" ads on TV.  This is one sorry company.  We only have $1000.00 limit and are not maxed out.  Never been late, never over limit, and pay more than the minimum due each month.
The last billing statement had our APR applied at 26.26%.  Of a $35.00 payment the finance charge was $18.14!  We are now shopping for a card with a no-fee balance transfer.  And Capital One knows what it can do with it's high interest rates!

Unauthorized and announced extension of billing cycle:  for years, my Capital One card had a closing date the same as the final calendar day of the month, with payment for that month due the 3rd of the following month.  I always pay my balance in full and schedule purchases with this in mind, e.g. usually waiting till the beginning of the next month/billing cycle to purchase airline tickets, when needed.  This month, without warning, my May statement includes charges up to and including June 8 (instead of May 31), with the payment still due on July 3.  When I called Capital One, I was subjected (as usual) to long waits and phone menus, only to end up back at the "main menu" after 15-20 minutes of wasted time.

Complaint:
I had a Capital One credit card for a number of years with a credit limit of over $20,000. Earlier this year, at a time when my balance was about $14,000, I received a notice with my bill that my interest rate was being increased by 5%, unless I opted out. At the same time, Capital One was sending sign-up offers at an initial interest rate lower than the one I had already. So I called, opted out, destroyed the cards, and paid the entire balance, plus about $1,000 to be sure. This was done in March. My April 14th bill showed a credit balance of over $1,500; however there were a few transactions that did not post until March, so I knew I wouldn't get my money back yet. Capital One's stated policy is to pay final balances within 10 business days after the account has shown no activity for a full cycle.
My May 14th bill showed a credit balance of over $1,400, no transactions, and therefore I should have received a check within the 10 business days following that bill. No check. I called Capital One, got an apology, and was told I would have my money within 15 days.
Yesterday, my June 20th statement showed up, still showing the same credit balance - obviously no action had been taken. After talking with two different customer service representatives, I finally got to an account manager, who told me that a computer error had been made and she would have to do a manual entry, which she did. She then said I would have my check within 30 days. When I told her that the check was already over a month late, and Capital One's stated policy was to pay within 10 business days, she came up with a comment about the 30 days being due to the fact that the check was over $1,000 (duh!). No use complaining to the FTC or other agencies about this unacceptable behavior, but what really upsets me is that Capital One would raise the interest rate of a known excellent customer with a long history of paying interest in favor of getting a new unknown customer who may not make them any money. One of my sisters-in-law owns several banks. If she did business tha!
t way, she'd probably be lucky to have enough to eat. So, what's in your wallet? (ROFL)

Complaint: In the fall of 2004, I started an account with Capital One.  My original credit limit was $201.00.  I am a college student, so it was something very manageable for me.  I am not sure why, but a few months later, I stopped receiving bills.  I called and requested that bills be sent to my home, verified my address, and even made payments while I was at it.  About a month after that, I did get a bill, from a collection agency for double my original credit limit.  I was furious.  As a bill collector myself, I was well aware of my rights.  I immediately disputed it and explained that I never even received a bill.  I offered to pay the original credit limit in full that day and was told no.  I am still being charged a fee for this card each month, and it is still having interest added to it.  I have a fee each month for being over my limit, late payment, and a monthly feel.  I have requested that the card be canceled and the company refuses to do so.  I had very good cr!edit before Capital One.  Now, I have none.  My balance has swelled to nearly $1,000.  It isn't something I can afford.  My place of employment closed down and I haven't found work yet.  Capital One is a company that could care less about it's customers.  I receive no less than five calls a day at my parents home.  They are able to call so often because they don't speak to me.  They can call as often as they want in one day until they speak to you or your spouse, depending on if your state's laws allow it.  I've offered to pay no more than $300.00 on this account and all of their collection agencies have refused it.  If they want their money, they will take it.  Don't deal with collection agencies!  You don't have to!

Complaint: I had a unauthorized charge from a company and reported it to Capital one's investegations dept. They reversed the charge. 2 months later the company charged my card  again and capital one said send in proof that you didn't acknowledge the charge. So I did. 7 months has passed and now they are saying I owe for that charge and for all the late fee. Within the 8 months of this mess up I've called about 20+ times and got names of everyone I talked to and some were very rude. Finally I spoke with Carolyn, a so called senior supervisor and she called me a liar and that no one in her dept. would of told me what I was telling they said. She said the names of the reps. and the info I was given were all made up and my whole story was a lie. She must of been the rudest person I've ever spoken to. She had an arrogant giggle in her voice as she called me a liar. I was crying because i couldn't understand how a customer service rep. could be so cold. I'm a full time medical st!
udent and a mother of 3, I can't afford to pay $300.00 for something I didn't even order. I called it fraud, but Carolyn, capital one rep. said it wasn't fraud it was a miss communication of charges. I hope someone can shut them down.

They are the worst company out there! When you try to talk to someone, they are usually in India or Pakistan, reading off a script, and very hard to understand. If I have to hear, "how are you today, ma'm?" one more time...
I have had this card since 1998. Apparently, it is an account that does not allow me to ask for a credit increase, nor am I allowed to ask for a change in my APR. It is all at their discretion. Talk about being held by the ba--s! I did not know this for years, and would regularly ask for one. Well get this, I can't ask for one, but when I did, I would get a ding on my credit report, all the while they know I CANNOT ASK FOR ONE! And nobody told me until recently that this was the case. Also, I have been with them this long, and they have given me a total of two increases. One from $300 to $800, and then five years later, from $800 to $3000. Wonderful.
One time I had a problem paying my bill, and had called in to see if there was anyway possible to avoid the late fee. I had just moved across country,  money was tighter than anticipated, and I was deseperate. The supervisor I spoke to said to me, "stop making excuses and just pay your bill." I was so offended by this. If there was anyway I could have paid that balance off and closed the account, I would have. That is my goal though. I work two jobs, and hope to have that card paid off asap, and then I cannot wait to call them to close it, and I will state that reason why.

No hassel?!  How about a credit card that not only charges unreasonable interest, but adds over limit charges to your account when THEIR charges put you over the limit!?!  Two months ago the yearly fee plus interest put me over my credit limit, for which they charged me $39.  The next month the interest did the same and I received another $39 charge.  I had not even used my card during either of these two months.  I have a good credit rating and usually pay online at least one week before the payment is due.  Why not contact them you say?  Well, it is literally impossible to speak to anyone about this.
Take  your chances with the local loan shark, but stay away from this credit card!!

Complaint: In an attempt to use Capital One miles rewards I contacted Capital One prior to making my airline purchase.  I was delightfully surprised and exited when the customer service representative checked my mileage availability and advised that I have more than enough miles to make the purchase.  After the purchase appeared on my credit card, I contacted Capital One to redeem my miles.  At that point the customer service representative told me I don't have enough miles for that purchase.  With my attempt  to get information on who gave me the wrong advise I was transferred to a supervisor named Careth.  She bluntly told me that maybe I heard what I wanted to hear when I was originally calling before my purchase.  No wonder Capital One has such bad customer service rep.  Needless to say I will be closing my accounts with Capital One.

The worst credit card company I have ever dealt with. They charge interest on a cash advance from the moment the advance was taken and the charges appear on a seperate statement from the "normal" credit statement. I never recieved this second statement due to their problems with mailing, so charges kept appearing on my credit card statement, but no-one at CapitalOne would/could expain the nature of the charges. When I complained the only option they gave me use to cancel the card.
WHICH I DID!

Capital One provided a promotion for 0% for transfers.  However, not realizing, that if for example: you finance 2,000 for transfers at 0% and then you charge 500.00 at their rate of 15%.  Any payment(s) go towards the 0% first and not one single dime goes towards the purchase balance.  Therefore, if you make 100.00 payment it will reduce the 2,000 to 1,900 and the 500 will increase 15%.  This will continue to spiral out of control until the 0% balance is paid in full.  So if it will take you 19 more months to continue paying off the 1900 @ 100.00/mth (even over beyond the minimum) the 500 will continue to increase significantly as it progresses.  JUST ANOTHER SCAMMING WAY TO MAKE MONEY and HURT AN INDIVIDUAL with GOOD CREDIT.   All promotions, purchases, transfers should incur some percentile of the payment made.

Complaint:
I had two cards with Capital One.  One with a 1211.20 balance and the other 267.52 balances.  I called Capital One and paid them both off in full over the phone.  As I was going through the process of paying them off over the phone, I explained to the clerk many times how important it was not to use the checking account I have used in the past to make payments over the phone.  I completed the phone call by making sure she used the new checking account, she said yes, so I thanked her and hung up.  Two months later  Capital One called and said I need to pay 1351.20 which was the  1211.20 plus "their $140 in penalties".  I explained,  I had already made the payment in full, Capital One said how would you like to make your payment, the Capital One lady even told me the bank, Capital One used,  was the one I told them not to use.   Yes, the clerk had used the wrong check information.  Capital One insisted I pay the full amount.
I paid the original amount of 1211.20, (well actually I paid 1,216.52.)  I was so upset that Capital One would not even listen to my explanation they got an extra $5 from me.  I made it clear I will never do business with them again.  Anyways, that was back in 03/25/03 and the second call in 05/28/03.  Today the 140.00 I refused to pay has escalated to over 700.00. i tried many times to explain this situation, most of the collectors just could not understand.  Yes, Capital One has hurt my credit score.  Someone is again trying to collect from me.  Capital One you have issues!  Is this common out there, are others having these kind of problems with Capital One?

Complaint: Since I had a 4.99% fixed interest rate on my Capital One card, I decided that it would be a great thing to use during my kichen remodel.  I know that credit card companies look for any small issue to jack your rate up after you have a balance, but I wasn't concerned.  I always pay on time, and use my credit wisely.  Unfortunately someone got my number and committed fraud on my account over a 2 day period before Capital One caught it.  I was very happy with the company because they caught the fraud and called me.  We worked through all the charges on the phone and all of them were declined.  Great service...right.....until I got my next bill and my APR was now 27.99%!!!!!  I called immediately and was told that it was probably because the fraudulant charges put me over my limit.  A request to lower the % would be put in.  Six days later I got a letter stating that they were within their rights and my APR would remain at 27.99%.  I was FURIOUS.  How can a company j!
ack your rate 700% when you live up to your side of the contract?  I have had the card for over 10 years and have NEVER missed or been late on a payment.  When I called to cancel my card I was offered 12.5% which made me even more mad.  Needless to say I will NEVER own another Capital One card and my wife is calling today to cancel her account as well.

Complaint: if you are looking to get a capital one credit card DO NOT.  there customer service sucks.  they are not there to help there customers.  i have filed a dispute on my account 6 months ago, spoke with 7 different people and no one would help.  at first they credited my account and then a couple weeks later they took it back and said they need a letter stating why i was disputing.  i sent the letter the next day.  3 out of the 7 people said they see the letter and i should see the credit within 7 business days.  well after fighting with them for 6 months i still have yet to see the credit.  i finally talked to a manager and he was very rude and ignorant and said sorry we are not crediting your account cause we never received your letter. i was like you got to be kinding me.  i told him that i will be canceling my account and he said SO WE HAVE ALOT OF OTHER CUSTOMERS.  what??? wow.  so please do not get this card

Complaint: Capital One has the worst customer service I have ever encountered. I opened the account in September after receiving a 0% offer. There were errors on my bill starting the first billing cycle. I called every month and was told the issue would be corrected. I was on the phone with them once a month for over an hour, at least 20 minutes on hold before any one even answers. Now it is April and I just spent the last two hours on the phone with them and told them they can keep the disputed amount, just take my payment and close my account. I had no confidence in them ever correcting the situation and figured I better cut my losses as the erroneous finance charges would keep accruing if I kept the account open.

We had a small business credit card with Capital One and recently called Capital One because our personal card had both me and my husband as primary and secondary holder, however, we were informed we could not do that on the business card. In any event, my husband died and thinking I was doing the correct and right thing I contacted Capital One to inform them of the situation and they immediately closed the business account and I was first informed I would not lose my miles but just transfer to a new account. BUT, in the end they closed the account and I LOST over 3! 81,000 miles, YES it is the correct number and was treated so poorly after being an exemplary customer, never late payments and obviously used their card. I would advise anyone married with credit cards, make sure of your status with those cards and you are not just an authorized user. If they do not allow two holders of the card, don't use them.

Complaint: I have been a customer with CapitalOne since I was 18, unfortunately at 24 I do not have an extensive enough credit history to cancel the card without negatively affecting my credit. For the past several months I have made only the minimum payments on my credit card which is maxed out. Every month I am charged interest which puts me over the credit limit and I am then assessed a $39 overlimit fee. I finally was fed up enough to call the customer support number today to speak with a man with a very thick accent that called himself Steve. I told him that I was under the impression that the minimum payment that was require! d of me was enough to cover all interest plus some principle and I asked if this was correct. He said that I was correct. I asked him how if that was the case I was continuously being assessed overlimit fees. He told me that even if my account is over the limit by $0.01 that I will be assessed a fee. I told him I understood that but I did not understand how the minimum payment was not enough to cover the interest and principle and I therefor ended up overlimit every month. He explained that the minimum payment did not include fees such as overlimit fees. In my opinion this is just a way of scamming customers into paying more outrageous fees than they are already, avoid Capital One at all costs!!

Complaint: August 5, 2008 Federal Trade Commission Consumer Response Center 600 Pennsylvania Avenue, NW Washington, DC 20580 Dear Federal Trade Commission: I am writing in reference to fraudulent practices on the part of Capital One, whose address is P.O. Box 30285, Salt Lake City, UT 84130-0285. This company has made two fraudulent representations that have cost me money: 1. Account representative Jovan #OPJ651 said that if I accepted a 0% offer, and carried a balance on purchases that were subject to the 12.9% rate, my payments would apply to the portion of the balance subject to the 12.9% rate. 2. When I pointed out this misrepresentation (upon discovering all my payments were being applied to the 0% balance), I was told by someone who only identified himself as "Brad" that I could have a 9.9% interest rate. I have discovered that this rate was never put into effect, and I was not notified. I spoke to this Brad on June 2, 2008, and he told me the new rate would go into effect on June 6th, 2008. On August 5, 2008, in answer to my phone query, I was told the new rate did not go into effect and would not be implemented. The representative I spoke to on August 5, 2008, refused to tell me what agency to report these fraudulent claims to. I asked repeatedly for the name of the agency with oversight, and the representative I spoke to on August 5, 2008 repeatedly refused to give me that information. Thank you for your attention to this matter. Sincerely,

Complaint: This letter is being mailed to Capital One's Customer service. I post this here in hopes that others will become very savvy concerning credit cards (debt) and that we all work to force the fees that they're able to charge be regulated. We are The Customer, giving us the right to force them to change their operating practices. What would they be without us, The Customer. October 22, 2008 Capital One PO Box 70886 Charlotte, NC 28272-9903 Dear Customer Service, I am writing in Reference to ACC # ....... I had been a customer of Capital One since 1993. I stopped my attempts to pay on my debt in April 2008, when my employer began to have a decline in donations, which affects my salary. I write to say that it is not my intent not to pay off my account but to make arrangements so that when I’m able to begin paying, I will have assurance of paying it off, even during these times of economic troubles. In January 2008, my balance was $778.39; my purchase limit was $800. I tried to pay down the account, only to realize in March that the finance charge and the added penalty charge of making a late payment put me ‘over the limit.’ I then was charged $39. I became ‘over the limit’ because of the late fee charges, not because I was misusing my card, double penalization for not being able to make a payment. I have since cut my cards. My attempts to pay down this account were futile, as financial difficulties at that time had made it difficult to pay on time. Once I missed a payment I was penalized for $39 for each late payment. I was charged a late fee and then penalized for being ‘over the limit’. During this time, I spoke to several phone representatives and asked that the fees be stopped by closing the account out and that the ‘over the limit charge’ was an unethical charge, since I was not misusing the card. I hoped that by closing out the account the charges would stop. My request to close the account was never acted upon, except the ‘over the limit’ charges did stop in June. Months later, I did receive a letter from Capital One saying that my charging privileges were suspended. I had asked the account closed months before. Now, the amount owed is $1,176.50, $156 of that amount is from ‘over the limit’ charges. I am seeking a second job to pay off this debt. However, I realized that if I paid half of the balance, and then lost my job months later, I would soon still owe the same amount or even more; because charges again would eat at my efforts to pay. With financial difficulties as they are for everyone, I see no point working to lower a balance that will only eat up my attempts to pay the debt. This is wasting money that’s getting harder to come by. At this point credit rating is not a concern for me. I continue to work toward a second job to pay my debt. I do ask however, that the account be completely closed including finance charges to stop. This will allow me to pay off the debt as our economy stabilizes, grows, or slows. I am asking for a locked in amount of $1,020.50, this is the amount of the finance charges minus the over the limit’ charges. I request in writing that all telephone calls regarding this debt not be made to me at my place of employment, the number is . I will attempt to begin payments when I am drawing a salary again. Sincerely, Shirley Smith The Customer

Complaint: The Capitalone mailed several times to me saying that they charge no annual fee for preapproved application for a credit card. I accepted it and got a new card. The troubles come. They charged $0.09 for each $100 purchase for the first month. I called them and told them I did not enter any protection plans and asked them if there are any hidden fees, and without my consent they cannot charge anything. They said they understand and won't happen again. But then next month, they charge $5.99 for some plans again without notifying or asking for my consent. They are making authorized transactions. But they are the c! ard company. How horrible they are! We complained disputed transactions to card companies. But now they invent disputed transactions themselves. Where can we complain to? Are they thieves?

Complaint: I was on a vacation had auto pay for my credit cards. I missed one my Capital One card. They charged me a $39 Late Fee and on the same statement they charged me a $20 Membership Fee for what I don't know. The Late Fee and the Membership Fee then put my balance over my limit so they charge me a $39 Over Limit Fee. So I've been charged $100 in fees. When I called and got somebody from India, I asked to speak to a supervisor, another India. I argued with him on these fees. He said he could take off the Late Fee. I said thanks, but now how about the Over Limit fee and the Membership fee? A! nd asked exactly what am I a member for and what do I get for my $20? He said it was to maintain the account and for rental cars, etc. I said I don't want that and don't need it and began to get loud. He then hung up on me. I was ultra furious. I immediately posted a complaint with the BBB.

Complaint: Customer service representative contacted me on Sunday evening about 6:30 p.m. Obvious from conversation and difficulty understanding service rep that call came from overseas satellite office. It's frustrating enough to fall one month behind in payment, especially when the fees tacked on are in the range of $60, but to have to attempt to carry on a conversation with a person whose first spoken language is not english makes the ordeal even worse. Frankly, I don't even know what the service rep said. I understood, "...check by phone." Capital One ... what's in your wallet? Well, not Capital One any more.

Complaint_against: Capital One Credit Card Company

Complaint: September 8 : I received an offer for 0% a Capital One credit card with 3% balance transfer fee. In the fine print it said that if the balance was paid off in 60 days the balance transfer fee would be waived. I called Capital One and applied for the card. I received the card and transferred the balance from Chase to Capital One on 9/17. I confirmed the terms and the waiver of the transfer fee if paid off in 60 days with customer service rep #VNM232. Unbeknownst to me they never made the transfer because of an oversight or mistake on someone's part. Sept 26 I received an offer from Chase for a 0% credit card, with no balance transfer fee, and decided to pay off the Capital One card (which I thought had a $19,000 balance on it) with a balance transfer from the Capitol One card to a new Chase 0% card with no balance transfer fee. Chase sent Capital One $19,000 on 9/29….however because Capital One had never made the initial transfer, they, Capital One, took the $19,000 and applied it as a credit balance. Now I had the $19,000 balance on my original Chase card still owing, a new Chase card showing a $19,000 balance, and a Capital One card with a $19,000 credit balance. On October 1, having discovered that Capital One had never made the balance transfer as I requested on 9/17, but was showing a credit balance of $19,000, I called and after several hours and many transfers from one representative to another, I spoke with a supervisor named Bissett #CW219. She seemed to understand the sequence of events and apologized and told me that she would straighten the whole mess out. She said that she would send the $19,000 back to Chase to pay off the first Chase card as they should have done on 9/17, she also told me that she would pay Chase for the interest that I had accrued on the account from the time the balance transfer was supposed to have been made (which I am now told was against company procedure), and that no balance transfer fee would apply since the balance transfer had not been made in the first place. I now have received a statement from Capital One showing a balance transfer fee of $570.00, plus late fees and interest charges, for a total of $620.48. Talk about adding insult to injury. They didn’t make the balance transfer in the first place, they took $19,000 from Chase as payment on an account which had no outstanding balance, and now are charging me a balance transfer fee to send it back. I have called and spent several more frustrating hours on the phone being transferred back and forth, to no avail. I just spoke to a supervisor (Cheryl #OZO896) who told me that there was no one else at the company who could help me…..basically I hit a dead end. Unfortunately, I do not have the paperwork from the original offer from Capital One stating that the balance transfer fee would be waived if paid in 60 day, and the last supervisor that I talked to (Cheryl) said that there was no way to access those records, no way to get a copy of the offer that I received (which is ridiculous…..they don’t have a record of their offer?), and no way to contact the original supervisor who helped me even though I have her name and employee number. In any event, they did not make the balance transfer anyway, and what they are calling a balance transfer is when they had to send the $19,000 credit balance back to Chase. The entire mess started with Capitol One not making that initial balance transfer and now they are trying to charge me $620.48 for correcting their mistake………

Complaint_against: Capital One Miles One Credit Card

Complaint: I have been trying to close a Capital One credit card since 10/2008. It is now 1/2009. Two companies, "Credit Diagnosis" and "Your Savings" have been fraudulently billing this credit card account since 9/2008. I spoke with the fraud department in 10/2008. I was told by a rep that since these charges were not made by me, they could block future charges. This did not work - I continued to receive the charges. I called again and asked to CANCEL my credit card. I was told I could not cancel my card as it had a balance. This balance was from the above fraudulent charges, which at that point Capital One was crediting back to my account. I was told that my account would be canceled and a new account number would be issued - and that this should stop the problem. A month later, charges from both of these companies continued to appear on my statement - even with the new account number - which I was never even given! I called again and asked to have this account canceled. By phone I paid for two charges I had made and was told that once these charges were paid, my account would be at a zero balance - and the account would be closed. Surprise - this month I received a statement from Capital one, showing a new balance. Apparently the company who had fraudulently billed me the past, sent a credit to Capital one. So, Capital one reversed a credit they had given me - and considered it an old charge - and slapped me with a finance charge. I spoke to a rep today 1/3/09 - and was told if I paid the entire balance (which I did today)- by Tuesday 1/6/08 - I could call and REQUEST the account be canceled. I refused to pay the finance charge, which he said would be refunded back to me, as long as i made the phone call by Tuesday. In the meantime, if "Credit Diagnosis" or "Your Savings" manages to charge my account, I will be back at square one. Today I filed a complaint with the CA Attorney General's Office, as well as the Federal Trade Commission. I have wasted over six hours of my time on a credit card I have personally used less than ten times. Please, do not be tempted by the mileage program. This company is very difficult to deal with - and I am a good customer - with excellent credit!

Complaint: I have a complaint aganist Capital One. I knew that I was going to be experiencing some trouble paying the bill due to my 2 year old son having surgery and other medical issues, so I called Cap One and spoke to a representative in their Hardship Dept to make arragements on my account. They assured me that if I make 3 payments of $144.00 then my account would remain open. I went to check my account online today only to find out that it is restricted. I called and spoke to a rep. and they told me that my account was closed permanently. Any company that would mislead a customer like that especially in the situt! ion doesnt deserve to be around

Complaint_against: capital one credit card closure

Complaint: I'v been a capital one card holder since 2002. Just recently I bruntly recieved a letter stating that my credit card has been suspended for non usage of 13 months. I then contacted them to take the suspension off so I could use it and I was bruntly told NO. My other credit card companies would send me a letter stating to use the card or it will close. NOT CAPITAL ONE- they send you a letter of suspension without giving one a chance to use the card. BEWARE people. Do not get a capital one credit card. They are very inconsiderate with their customers. For those who have one, GOOD LUCK.

Complaint: I had not used my Capital One credit card for several years because Chase offered a more attractive cashback rebate. Then last month Capital One sent letters begging me to come back. So I did--even got one of those personalized Image Cards--but needed to find out if my account was set up to automatically pay itself each month from my checking account, just as Chase did. I sent a "secure message" from their web site on 14DEC2008. The web site promises a "full business day" to respond. Nothing. Around 21DEC suddenly a status update appeared--backdated to 18DEC, oddly enough. All it said was that they had forwarded my message to the appropriate party. It's now 05JAN2009, 22 days later, and still not a peep from Capital One. It's a secure message from their own web site, so they have every possible bit of information they need to answer my question. And, frankly, it's very simple question: Is my account set up for auto-pay? (Why I can't get that information on my own from the web site is beyond me.) So much for wanting my business back. Capital One won't even let me send them money! I just want to pay my bill. Bye bye Capital One. I'm headed back to Chase. Same rebate, although no Image Card. Whoopdidoo. Chase customer service has been stellar for years. I miss that now.

Complaint: Yesterday I noticed on my credit card statement that I was being charged 23.99 % interest on my balance. I called to as why and was told that it was because I was late on my 12/23/08 payment. I was also charged a $39 late fee. They waived the late fee and transfered me to someone else, who told me they had no plans to offer that would give me a lower rate. I was late due to an oversight on my wife's part, but was a 7 year cardholder with no previous history, but that didn't count for any consideration. I told them that they would lose me as a customer.

Complaint: I have been a long time customer and loved Capital One. They just recently decided to jack up my rate from 6.9% to 15.9%. WTF!!! I have never had a late payment. I would understand if they said my rate would be 15.9% on new purchases but how can they raise it over 100% on existing charges. I had to opt out because I had only 2 choices. One ding my credit for canceling a card that I have had for a long time or two ding my credit for not being able to pay my bill because my required payment skyrocketed.

Complaint: I have a Business card with Capital One and a personal card, each card has low credit limits of $1500.00 and $1800.00 respectfully. The first card has a low interst rate of 6.99% and I ALWAYS paid when it came in they would ask for $20.00 I paid $150.00, well within my credit limit under 20% of total and I got slammed this week with an increase of 13.99%, variable rate for no reason-they said because of the economy. EXCUSE ME if this is how you treat a good costumer who always pays on time more than asked for how do you treat a bad costumer?? I guess it is my choice not to do business with them anymore and reque! st my senator and congressmen investigate their banking practices. I think as tax payers we should be charging them 13.99% variable interest on their recent banking bail out! Wouldn't they rather have a customer who pays on time and is in good standing with a lower interst rate-than no customer at all if times are so tough for them? Did we give them so much money during the bail out that they don't need my business or other people like me? I'm angry when are people going to stand up for us-don't we have rights!

Complaint: I've had a card with Capital One for about five years. During that time, I've never been late on a payment, or ever gone over my limit. After losing my job a few years ago, I did get close to that limit. I'm now (hopefully) caught up, and I've stopped using the card, and I'm trying to pay it down. I'm making more than the minimum payment each month. I just received a notice that they were raising my rate from 12.9% to 17.9%, unless I closed my account by April 2009. I'd get an "introductory" rate until next March, equalling my current rate. I've sent them numerous letters! , and have received no response on the reason for the interest increase. The only reason they gave was "Due to extraordinary changes in the economic environment, we're reviewing our existing credit card accounts....." I get angry every time I see their ads on TV telling about how wonderful they are for consumers. They are full of greed, and are part of the reason the economy is in the state it's in today.

Complaint: Back in October i applied for a secured capital one visa card ( because of some past trouble i had this was a good way to restablish my credit).. i received a letter on oct 11 saying i had been approved, and to send a cheque in any amount over 300 and my account would be opened... i actually left the letter in a drawer and forgot about it until 3 weeks ago, so i sent a bank draft for $500 to them... i called them the other day as to the status of m account, and they told me there was no such account. i gave them the reference number right off the original letter, and after talking to 3 different people it was determined tha! t the account had lapsed.apparently the offer expires in 90 days...No where on the letter did it say it had an expiry date.. i then asked about my bank draft, and they had no record of receiving it.. so i went to the bank to put a stop payment on it, and the bank told me it had alreaday been cashed.. i called back capital one, and very rudly i was told that because the offered had expired there was no way it could have been cashed.. in the meantime i had sent them faxes , front and back of the money order, with all of their deposit stamps on the back etc, and everytime i call they say , well we are unable to read a certain number,so i have faxed it sereral times.. i asked what their address was so that i could mail them the copy, but they are not allowed to give out an address... so as of right now its still up in the air, going around and around.. i would have waited til the problem was resolved but found this web site and wanted to vent ...

Complaint_against: Cap 1 failure to notify me of delinquency

Complaint: To make a long story short my estranged mother took out a card in both our names and I found out about it five years later (9-2008) when I bought a house. After failed phone call attempts I sent a letter to Capital One informing them that this card was taken out without my knowledge and I would like to place a freeze on the account. And ofcourse I included my address and phone number in the letter in case I needed to be contacted. A few weeks letter I received past bills as I requested. Then five months later (4-15-09) I received a noticed addressed to my mother(no where was my name mentioned) and it informed her that her capital one card was now 120 days past due and is in collections. I called and spoke with capital one (who were rude, threatening & unhelpful) and I came to the conclusion that I would pay the balance to make it go away. I then ordered my credit report which was now reporting the card as delinquent and my score was 40 points lower. Now for the next 7 years I will have to have this on my credit report. What really angers me beyond belief is the fact that I provided Capital One with my contact information and I was never once contacted about the delinquent account. If something is affecting my credit am I wrong when I say it is that institutions obligation to inform the individual? I have just sent out 2 letters to the company insisting they have this delinquent account removed from my credit report, but why do I have the feeling that I wont even get a response a from the criminals. I just absolutely despise Capital One. Please include me in any lawsuit against this atrocious company! I am sure my rights were violated when they failed to notify me of the delinquent account, I just don’t know what my rights are regarding the creditors obligation to notify card holder of past due account? Someone please help me!

Complaint: This credit card company is the worst I've ever worked with. They raise rates indiscriminately, apply late charges when received on the due date but not posted by themselves. I canceled the card and recently accidentally sent them a payment due to another credit card company. When I called "customer service" I was told that they'll send me my credit balance after two billing cycles - as stated in the cancellation agreement. So if we're late a day they charge ridiculous late fees and when they owe us money they hold it for two to three months before returning it. Awful.

Complaint: After moving all my balances and using this credit card exclusively because of the 7.9 rate I was given, they have notified me that my transaction fee will be raised to 17.9. I have no say in this. I have never been late and always paid much more than the required payment. After talking to someone from "India" who could only read off of a card I was informed that any special balance transfers are locked into the rate but all purchases(new and prior) will be raised. When I make a payment, it applies to the lowest rates first so unless I can pay this off the purchases I made at the "low rate" will now be surcharged.! I think this is fraud and I would join in any class action suit against them.

I have talked to several Capital One representatives about this and their response has been that they are within their legal rights to raise the interest rate. One representative told me if I didn't like it I should pay the balance off every month. I have been out of work for 4 years and always paid my balance in full in the past when I worked full time. Complaint: For several years we had a Capital One card with a 4.99 % interest "for life" which was what their offer said when we applied(around '97 or '98). We never! went over our limit and were never! late with a payment. Then out of the blue in 2006 we receive a letter that says our new rate is 9.99%.I called to complain and was told "We just can't operate at that rate(4.99%) so we are raising your rate". I told them that wouldn't do and would transfer my balance to another card,to which they replied "we can give you 8.99%".To which I said okay. Now in 2009 we get another letter saying that our rate will be 19.99% starting august! 1st. How is this able to happen? Who can I complain to? We are definitely transferring our balance to another card , but there should be a government agency that watches lending practices like this. Our original agreement stated that they wouldn't raise our rates unless we went over the limit or were late more than twice with a payment.

Complaint: I make a monthly payment before the due date. I made a payment a day earlier than I normally due and when I went to make my current payment, my statement said I had been charged a late fee. I called the company to inquire why I had a late fee. After talking to two different people I was informed that I had paid to early so the computer thought that my payment was being made for the prior month and late at that so I was charged a late fee. I was told that the late fee would be credited toward my account the following statement. I said that was unacceptable since I was still out the late! fee which I still have to pay because they cannot change the bill. Crediting my account with the late fee amount does not reduce my immediate payment. So by doing a good thing, I am penalized. I told them to issue me a check for the late fee and Ii would gladly pay them with that. They laughed. I am not laughing.

Complaint: I have had a credit card with Capital One for 10 years. Never late, Never paid minimum payment. Spent loads of bucks over the years. They just raised my interest rate by 3.9%. They told me on the phone that they raised it not because there was anything wrong with my account, but, that they had made a "business decision due to economic circumstances". They refused to budge so I canceled my card insurance. They are getting around $5 more in interest payments on current balance but they are losing $13 in insurance payments. They lose, and they got the card back in 10 pieces.

Complaint: I paid off the credit card, and was surprised to get another statement for $5.85 When I called to ask specifics, "Adrian" at the "customer service" number was unable to describe what the charge was for. Was it a finance charge? Was it interest? Could she explain where, on the statement or customer agreement this charge was described? NO. To comply with FTC consumer credit rules, I sent, in writing, (within the 60 day required period) a request for a description of the charge. No reply from Capital One. I received, instead, a late fee of $29.00 and a threat of collection. I replied, in writing, tha! t Capital One was now in violation of the law, and that if they expected me to pay the $5.85, I still wanted to know what it was for, and would not pay any late fees. Capital One sent form letter, telling me that as my account was now delinquent, they were unable to assist me. That I should call their customer service department and speak to them. I reminded Capital One IN WRITING that they had still not addressed my query of charges. That my rights were only protected if I responded in WRITING, so why would I call them? I then received another statement, was billed another late fee, and received another nonresponsive form letter. August 29 will be 90 days after the first written query and dispute.

Complaint: I contacted Capital One to close my credit card. I was told that the interest rate was going to double on the next statement. When I told them I had no notification of the change, they told me they mailed out a letter with the change. I did not receive a letter. I do my banking online. I went to my online page and printed out the statements for the past 4 months and there was nothing on the statements stating a "Change of Terms." I then called them back and told them again that I did not receive anything in the mail and checking my statements there was no information regarding a change of terms. I then pro! ceeded to close my credit card account. I don't see how they can change anything without letting me know. Sending a letter through the USPS is iffy at any time. Complaint: I took advantage of Capital One's special offer for 0% interest for 1 year with 2% fee. Before doing that, I paid the balance of whatever purchases I made 8/22 which is a Saturday, (and apparently after 1 or 3 pm Eastern time). Since the payment was made and was accepted by the credit card company on the same day (just not posted yet), I requeted the balance transfer in the afternoon of Sunday 8/23. Per CapitalOne, the balance transfer could take up to 1 week to be approved, and actually the payoff was made a few days later. WELL, what do I know? My payment of! $34.67 was posted at the end of the business day, Monday, 08/24 and the balance transfer they put in on the same day Sunday 8/23. As a result, I am being charged a whopping 17.99% interest on the $34.67 and all my payments beginning September is now being credited to the 0% interest rate, even though I am paying more than the minimum requirement they are asking for. I've been a very good customer of CapitalOne and always pay on time. I was told that CapitalOne will credit this months' interest, but can only do that one time! This means that the $34.67 plus the interest every month that will be put on this will keep on going up and by the time I know it, I could be paying more on it that the balance transfer amount. WHAT A RIPOFF!!! Consumers BEWARE!!! Get rid of your CapitalOne credit cards before this happen to you. I closed my account and will shred all our cards on this company. That's one customer they lost for life and I will keep on telling my friends and business associate about this. I'm also filing a complaint against CapitalOne with the appropriate Consumer Agencies.

Complaint: On 10/21/08 I open a 0% interest for 1 year platinum credit card with Capitol One. I paid the minimum balance on the credit card until my October 2009 statement. On October 3rd I called the Capitol One customer service center and inquired when I needed to pay in order to avoid any finance charges and spoke with Sue. I was told that as long as I paid the bill in full before my due date on 10/28/09 I would have no finance charges. I paid my bill on 10/27/09 for the full amount over $4,000.00. When I received my November statement I had a finance charge of $31.79. I called and spoke with Madison. I explained my situation which was 1 year with 0% interest and Capitol One charging me interest prior to the year being up. She informed me that she would request a credit but I would still need to pay the bill because the credit would not be applied to my credit card until the next billing statement. I asked to speak with manager because I wanted to avoid making another payment for what I believed to be their error. I was transferred to Pinkie who proceeded to tell me that she would issue the credit but I was charged interest as of 10/1/09 even though the advertisement stated I wouldn't be charged interest for 1 year. Since I opened my account on 10/21/09 and they were charging me interest prior to that date I felt it was false advertising. Pinkie placed me on hold and when it was picked up next I was speaking to Pauline an account manager. I was not told I was being transferred. I explained the situation again to Pauline who was extremely rude, informed me that they are not allowed to issue credits for finance charges and she didn't know what I was talking about. When I told her about the two previous individuals I spoke with, Madison and Pinkie, she told me she didn't know them but I was misinformed. When I told her about opening my account and being charged finance charges prior to my 1 year date she informed me that in order to avoid finance charges I had to pay two consecutive bills in full which I had not done therefore I was charged and there was nothing she could do for me. I went back and read the disclosure for the 0% interest accounts and no where is it clearly stated that I must make two consecutive payments in full to avoid finance charges being charged prior to my 1 year. I believe this is shady business practices and I would discourage anyone from doing business with Capitol One. I have closed my account. I actually asked Pauline to do so in the same conversation where she informed me she didn't know those employees who transferred me and I wouldn't be receiving a credit because I didn't do what I was informed of on the back of my disclosure notice. Hopefully I will not have any additional problems with this company. I discourage any and every one from doing business with this company. They have very poor customer service relations and they have questionable business practices. It would seem they are notorious for unclear business practices and prey on individuals who are trying to rebuild their credit or are just starting out. There are better, more reputable companies out there. Providian and Citibank is just an example of a companies working for their customer not against them.

Complaint: without notification they changed my billing dates. they added days to billing cycle. my bill is paid in full and on time every month, but by them changing the billing dates it made my bill for the month higher by $3500. I have the money to pay for it but it wasn't budgeted for my business this way, what if I where someone that didn't have the extra money because they changed my dates. terrible business practice it is like they are trying to set you up to not be able to pay your bill in full.

Complaint: Beware of the shady practices of CAPITAL ONE. As they encourage you to use the on-line bill payment method and they also use it to deceive you. Also, they will not issue any kind of resolution proof to you, based on your conversations with one of their representatives. Recently I was over the limit on my account due to an automated charge. I spoke with a rep and paid what I was told I needed to get it under the limit and I was told that they would reverse the 39.00 fee as a courtesy. Well the reverse never happened and for 3 months I was over the limit. Capital One sends no flags to you concerning your account, even though they have your e-mail info. They have no indication on the web site that you're over the limit. They just keep asking for minimum payment like everything is fine. And why wouldn't they, they keep charging you $39.00 a month. Although however, at the bottom of the statement it does say over the limit fee $39.00. The problem is that I'm doing everything on-line and when you are on-line, paying your bill, nothing indicates you're over the limit. I have already closed one account with CAPITAL ONE as they have informed me twice that they are raising their interest rates due to the economy and recent changes in legislation. I guess I will be closing this account as well. Just another way for the Banks (credit card companies) to keep squeezing you for money. We need more legislation on credit card companies. They have simply become legal loan sharks. And now CAPITAL ONE has joined this group of financial gangsters.

Complaint: I had a Platinum Master Card, with a fairly good interest rate, beginning in July of 2005. Unlike many people who had $10,000 of unpaid debt on their credit card, I had no debt. It seems if you do that for 13 months, they will cancel your card with no notice. I think this is ridiculous. I suppose I'm too retro... I wanted the credit card as an emergency thing, not to constantly buy things I couldn't pay for. This used to be called prudent and wise. Now I'm being screwed.

Complaint: Recieved notice on current bill that my intrest rate will be increasing 10% next month. I called to opt out. Customer service said they sent me a letter in the mail in May 09, and I had until July 09 to opt out. I opted out of paper mail from Capital One years ago. All of the correspondence is online. I was unable to find this letter they sent me. Customer service states, they did not send an electronic copy. Odd... Why not?? Somewhat deceptive practice. Capital One has no proof I recieved the letter. I have no proof they sent it. From this, they are claiming they have a right to raise my intrest rate. I have had my card since 1999. No missed payments, No late payments. If I have to pay this intrest rate, I will default on the card. Captital One prefers this than lowering my intrest rate to a managealbe amount. I thought the taxpayer bailout was supposed to prevent this type of abuse/fraud from Credit Card Companys.
